Cancellation due to weather is at the discretion of the captain. The charterer will have the option of re-scheduling the charter (to take place by October 15th) Last Minute Cancellation by the charterer is not refundable. Possession of illegal drugs on the vessel shall result in immediate termination with forfeiture of all monies paid. Zero tolerance is in effect. Captain is competent, not only coastwise, but in deep-sea navigation. The Captain shall handle clearance and the normal running of the yacht and be responsible for the safe navigation of the vessel, and the Charterer shall abide by his judgment as in sailing, weather, navigation and pertinent matters. Should the yacht, during the period of this charter party, be lost, stranded or disabled by act of God, fire, perils of the sea, or other unavoidable accident, rendering her unfit for the use or purpose of this charter and not brought about by act or fault of the Charterer, then the charter shall cease from the time thereof and neither of the parties shall be liable for the loss, damage, expense or inconvenience arising therefrom. Charterer agrees to be responsible for and to replace or make good any injury to the yacht, her furnishings and equipment, caused by himself or by any of his party, and to return the yacht in the same condition as received, less ordinary wear and tear. The yacht shall be surrendered free from any indebtedness that may have been incurred on account of or by order of the Charterer. Charterer agrees that this yacht shall be employed exclusively as a pleasure vessel for the sole and proper use of himself, his family, friends, company, and servants during the terms of this charter. The owner shall, for his own protection, keep the yacht fully insured at his own expense for the period of this agreement. In case of any accident, the Charterer shall give immediate notification to the Owner the same. Adding “additional insured” for the charterer may be available at additional cost to the charterer. True and faithful performance of the foregoing Agreement, the said parties hereto bind themselves, their heirs, executors, and assigns, each to other.
