Terms and Conditions Article 1: Object These General Conditions of booking/purchasing of nautical charters regulate the relationship between the Client and our company. As the owner of its own advertisements, both on its website www.jamm-ja.it, and on social channels, and our company undertakes to do everything possible to make the offers of nautical charters visible to the Client and whose charter offer satisfies the search parameters set by the Client. And our company does not represent either the Owner, in the event of boats not owned, nor the Client. The activity of and our company consists in establishing a direct relationship with Clients who want tourist services present on their web pages and social channels. Our company intervenes in the conclusion of the nautical charter sales contract only in the case of direct purchase, establishing a direct relationship (legal for the purposes of the laws in force) only in the cases just described. In the case of services purchased through nautical rental platforms, and our company is not liable for clauses not its own regarding acceptance of booking, purchase. Therefore, the customer must be aware of the purchasing conditions of the platforms. In the case of booking through platforms such as our company will retain 30% of the purchase plus charges in the event of cancellation by the customer up to 48 hours before check-in. Only in the event that the service cannot be carried out for safety reasons also attributable to bad weather phenomena purchased also through external platforms, the and our company will not retain 30% but only service charges. Article 2: Descriptions of Services Our company informs its users that it will do everything possible to ensure regular updating of the seasonal availability of the proposed Boats and the related technical sheets and equipment. The information provided on the Boats and the related photos represent non-contractual content. Our company recommends all users, before boarding, to contact the skipper to carry out the complete inventory. When using the portal, the Customer accesses and evaluates a certain number of charter proposals offered. The Customer through our company's system can receive detailed quotes on the offers of the Boats that meet his search parameters. Article 3: Booking procedure Search and choice of boat; Filling out the check-in in case of boat availability; By completing the check-out, the availability and price of the boat will be blocked for the customer. The binding acceptance of the quote and booking confirmation (by the Customer) will be concluded only upon payment of the advance payment of 50% of the cost of the boat only (only on its own site), and 100% on platforms external to our company. The boat will be booked in all respects in the name of the customer; Signing of the nautical charter contract. Article 4: Booking The Customer interested in booking a nautical charter uses the channels above to search for the desired Boat according to the search parameters that he pre-selects. Once he has identified the boat that meets his search criteria, the Customer can fill out the quote online (check-out). Only after The availability of the boat and price will be blocked for the customer with the payment made. As regards estimates outside of the services already indicated, they have a limited validity period, 10 days from issue.   Article 4.1: Binding acceptance of the estimate   It is the Acceptance of the clauses of this contract. The Customer, after having filled out the estimate (check-out) online, if interested in the offer, must proceed to accept the estimate. The Customer can accept the estimate by sending a confirmation email attaching the requests forwarded by our company. With this, the Customer undertakes, for all legal purposes, to finalize and sign the nautical charter contract with the Owner.   Article 6: Signature of the Owner's charter contract Once the payment has been made, the customer undertakes to sign the final nautical charter contract. The Customer must sign the nautical charter contract with the Owner within 1 day of receipt. The booking/purchase of the nautical charter will be exclusively subject to the contractual conditions defined by the Owner. Article 7: Use of the vessel – Responsibility The use of the vessel and any responsibilities are determined at the discretion of the Owner in the Nautical Charter Contract.   In any case, the following rules apply:   a) The Client undertakes to use the Vessel as a good responsible captain (ONLY IN THE CASE OF RENTAL), in the case of rental, the entire crew must respect what the captain instructs, both during navigation and not, and to comply with the regulations of the Authorities. In the event that, during the cruise, a skipper feels ill, stop the engine (as indicated by the captain before leaving) and immediately contact 1530 (safety at sea) or VHF channel 16.     b) In the case of rental, the Client undertakes to use the vessel solely for recreational navigation, excluding any type of commercial operation, professional fishing, transport, regattas or other, unless provided for in the rental contract in agreement with the Owner. This latter hypothesis will imply specific rules and obligations for this type of contract, such as particular insurance contracts, administrative formalities, etc., which the Owner and the Client must imperatively respect.     c) Sub-letting and lending of the rented/leased vessel are strictly prohibited.     d) In the event of a Rental, the Client undertakes to embark only the authorized number of people.     e) In the event of a Rental, if a breakdown occurs (dismasting, leaks, fire, etc.) the Client is required to urgently notify the Owner to request instructions, but at the same time request assistance from the Rescue Services via 1530 (safety at sea) or VHF channel 16. While waiting for the latter, the Client will be required to have a report drawn up by a Naval Surveyor/Engineer of the breakdown in order to obtain reimbursement from the insurance company for the sums covering the damage. f) in the event of a Rental, under no circumstances may our company be held liable. Article 8: Withdrawal of Clients   1) before boarding: any cancellation must be communicated to our company by email to the address.   It is understood that the cancellation terms are indicated in the signed contract. As a rule, the first deposit will not be refunded.   2) upon taking delivery of the vessel (in case of rental): if the vessel is not in a condition to sail, either due to the lack of an essential safety element or because the Owner is unable to offer a vessel with identical or superior characteristics, the Client must observe the cancellation terms indicated in the contract signed with the company. In any case, our company will be solely responsible for the return of the sums. It is understood that the amount of the sums to be returned to the Client may in no case exceed the amount of the sums paid.   It is understood that cancellations made by Clients are subject to the Cancellation Conditions defined by our company.   Article 9: Cancellation by the Owner   The Owner is not allowed to cancel any online booking/sale if there are no objective elements such as Damage to the vessel. In the event of cancellation of the charter by our company, it undertakes to offer the Client a replacement vessel of an equivalent or higher category. If this is not possible, it would be held responsible and would be required to return the sums paid by the Client, without the Client being able to claim compensation for damages.   Article 10: Boat Insurance and Deductible   Boats owned by our company have full insurance coverage, specifically RC and Hulls. To guarantee the Client against damages that he may cause to the hull of the vessel, its accessories and dependencies, partial or total theft and the main engine. However, the Client remains his own insurer up to the amount of the deductible and/or the deposit established at €800 (eight hundred/00). The insurance does not cover damage or loss of the clients' personal effects.   Article 11: Liability It is specified that our company provides tourist services, organizes excursions, convivial moments, events etc… as described on its website www.jamm-ja.it and external web platforms. In fact, it is not liable for any damage caused by the services managed indirectly Article 12: Disputes The parties expressly undertake to try to resolve amicably any dispute that may arise. If it is not possible to reach an amicable agreement regarding disputes between the parties to the nautical charter contract, they undertake to submit any dispute to the competent Court of the country in which the boat holiday was taken. With regard to disputes relating to this booking contract, they must be submitted to the Court where our company has its registered office.   By clicking on the "I accept" button, the Customer confirms acceptance of all the clauses of these General Conditions.
