Cruising Area and Rates Generally, the Vessel is based • May – October: Komodo National Park (Port: Labuan Bajo, Flores) • November – April: Raja Ampat (Port: Sorong, Papua) The daily rate for charters in Komodo National Park is $8,500 USD + 10% government tax. For charters in all other locations; including Raja Ampat, the daily charter rate is $9,500 US + 10% tax. Unless pre-approved, there is a minimum charter booking of 4 nights, and 7 nights within the following peak periods: 10 calendar days before or after Easter (Good Friday) each year 01st July to 31st August 15th December to 15th January If a charter is booked outside the scheduled cruising location, then a relocation fee may be levied. The price of this fee will be dependent on the locations(s) of the charter and will be relayed to you prior to confirmation of booking. Number of Passengers The maximum number of passengers for overnight voyages is 10, occupying 5 double-bed cabins. Fee Exclusions, Exceptions and Surcharges Trip cost includes: All on board meals, snacks, bottled water & refreshments excluding alcohol above the initial bar set up; shore excursions as outlined on the itinerary; entrance fees and permits at our seasonal home ports; transfers to /from shore to the ship; services of English-speaking cruise director; service of the crew; use of all water sports equipment including (sea kayaks) stand-up paddle boards, dive equipment including wetsuits for certified divers, snorkel equipment and fishing gear (where permitted by local regulations). The initial bar set up includes 6 Bottles of House White wine, 6 Bottles of House Red wine, 24 Bottles of Beer and 4 Bottles of House Spirits. A total of 50 nautical miles per charter day (50 NM) is included in the price of the cruise itinerary. Without additional cost, nautical miles can be accumulated as long as they don’t exceed the total of 50 NM multiplied by the number of charter days. Trip cost does not include: En-route accommodations at stopover cities at the beginning and end of your trip; • aircraft charter fees  • international airfare  • domestic airfare  • excess baggage fees  • passport, visas or airport departure fees; • entry permits, ports and handling fees outside our seasonal bases  • alcoholic beverages above the initial bar set up  • land expedition and cultural program costs  • PADI dive certification courses  • medical care; • land expedition and cultural program costs any; • land expedition and cultural program costs special requests and resulting transportation costs incurred in acquiring requested items; • land expedition and cultural program costs telecommunication costs for satellite phone and email charges; • land expedition and cultural program costs repositioning fees; • all government taxes; or • cancellation and medical insurance. In rare circumstances, it is possible that prices may be increased. While all efforts will be made to minimize the implementation of surcharges, circumstances under which this may occur include but are not limited to: • increases in transportation cost (including fuel cost). • increases in local taxes and duties (e.g. freight taxes, landing fees, embarkation / • disembarkation fees, sales taxes, etc.). • currency fluctuations. • significant government or park permit price changes. Booking and Deposit A deposit of 50% of the charter fee is required. Please note that services and booking will not be secure until a deposit is received by us or our agents. Alteration of Booking By you If a Guest, or an agent on the Guest’s behalf, wishes to alter a booking in any way, he shall send a request by email to us or our agent, as applicable. Any requested changes are subject to availability and prior approval by us, which may involve an increase in the price of the booking. If a member of a party is prevented from traveling the person concerned may transfer their place to someone else as long as our suppliers accept the transfer of names and the transferee, or their parent or guardian if they are a minor, signs a booking form. All costs incurred by us and any of our suppliers and any overdue balance payment must be paid before any such transfer is effective. By us We reserve the right either prior to or after departure to re-price, cancel or withdraw any tour, trip, or expedition for any reason whatsoever, and to alter or omit any part of the itinerary, to substitute crew members or leaders, or to change any means of conveyance without notice and without allowance of refund with the liability for increased costs if any, borne by the Guests. If a booking must be cancelled or interrupted by us due to unforeseen or unavoidable circumstance, such as: acts of insurrection, strikes, extreme weather, acts of God, terrorist acts, conflict, war or any other cause beyond our control, refunds will be based on the difference between the original trip price and the cost of services already provided. We are not responsible for: weather, sea or road conditions affecting the cruise and causing delays or re-routing, sickness, government action, flight delays and changes due to force majeure. Guests must ensure they have appropriate travel insurance in place in respect of such events, in accordance with paragraph 8 (Insurance). Cancellation of Booking Notice of cancellation must be sent in writing via email. We will not refund to you any deposits, administrative fees or alterations fees. Cancellation is subject to payment of the following fees: 100% of the total charter rate if the cancellation is made less than 60 days prior to scheduled departure Alteration of charter days resulting in a reduced total charter fee - loss of charter day total rate charged at cancellation fees as above Cancellation fees will be deducted from payment previously made to us and the balance, if any, shall be immediately due and payable to us. Guest Obligations Guests are also responsible for studying all pre-departure information, for bringing all detailed equipment and clothing, for conforming to standards of personal hygiene to minimize the risk of traveler’s disease and for acting in a manner considerate of fellow Guests and the countries visited. Guests are solely responsible for compliance with all of the laws and regulations of the countries visited. By paying the security deposit, the undersigned warrants and undertakes that all guests listed on the booking form are mentally and physically prepared for the itinerary, and aware of all risks associated with in water-activities and shipboard safety. All Guests wishing to dive will be required to provide proof of diving certification and some Guests undertaking scuba diving activities may be required to provide medical certificates, confirming their fitness to dive. Guests are advised that smoking is not permitted anywhere inside or below deck onboard the Vessel. We reserve the right to cancel, refuse service to, or expel from the vessel any Guests displaying inappropriate behavior, exhibiting medical issues that construe a safety risk, or for any other reason, at any time, during or prior to charter. Insurance Each Guest is responsible for purchasing suitable travel insurance for the booking before departure, including but not limited to trip cancellation / interruption insurance. This insurance must include emergency evacuation and repatriation costs in respect of all your activities (including scuba diving where applicable). Privacy Personal information that you provide when using our website and booking holidays will be treated in accordance with applicable laws. Limitation of Liability We, our agents, employees, and affiliates assume no responsibility or liability whatsoever in connection with the operation or service of any aircraft, motor vehicle or boat, other conveyance, inn, lodge or hotel which may be used wholly or in part, for services to Guests. Under no circumstances will we accept responsibility for any indirect or consequential loss whatsoever arising under or in connection with our provision of your booking. Nor do we accept responsibility for any injury, illness, death, loss (including loss of enjoyment and loss of business, profits or employment), damage, expense, cost or other claims or liability of any description whatsoever which results from: (i) any fault of you or any member of your party, (ii) any fault of any third party unconnected with us and the provision of the services for which you have contracted with us; (ii) any force majeure circumstances which are beyond our reasonable control. Our total liability to you in respect of all other losses arising under or in connection with the booking, whether in contract, tort (including negligence), breach of statutory duty, or otherwise shall not exceed the value of your booking (including taxes and deposit). Nothing in these Booking Terms shall limit or exclude our liability where such exclusion is not permitted under applicable law. Use of Subcontractors We contract with a network of businesses, firms, governmental agencies, and individuals for field services in relation to charter bookings. These businesses, firms, governmental agencies, and persons include, but are not limited to, Indonesian or other foreign-based companies, subcontractors, business concerns, agents, employees, and associates (all of whom shall be referred to as “third parties”). We do not supervise and cannot guarantee the performance of such third parties because of, among other things, remote geographic locations, lack of tele-communication facilities, time constraints, and governmental restrictions. Therefore, the undersigned, on its behalf and on behalf of each other Guest, knowingly assumes the risk and fully releases and holds Rascal Charters, our directors, employees and agents harmless from any and all liabilities for all of the acts and omissions of all such third parties. Waiver No failure or delay by a party to exercise any right or remedy provided under these Booking Terms or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy. Entire Agreement These Booking Terms, together with the booking form, constitute the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter. Each party agrees that it shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Booking Terms. Each party agrees that it shall have no claim for innocent or negligent misrepresentation based on any statement in these Booking Terms. Severance If any provision or part-provision of these Booking Terms is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this paragraph shall not affect the validity and enforceability of the rest of these Booking Terms. If any provision or part-provision of these Booking Terms is invalid, illegal or unenforceable, the parties shall negotiate in good faith to amend such provision so that, as amended, it is legal, valid and enforceable, and, to the greatest extent possible, achieves the intended commercial result of the original provision. Governing law These Booking Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the laws of Hong Kong. Jurisdiction Each party irrevocably agrees that the courts of Hong Kong shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation. Severance If any provision or part-provision of these Booking Terms is or becomes invalid, illegal or unenforceable, it shall  be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this paragraph shall not affect the validity and enforceability of the rest of these Booking Terms.
