- Santana is rented out with a skipper and is insured. - The boat is rented out in its entirety to the renter, whether a legal entity or individual(s), who appoints a person responsible for the renter. a. The responsible person is: - The owner requests the names of all participants no later than one week before the start of the rental period. Rental Terms – Delays, Cancellations 6. The renter must pay 50% of the total rental amount upon signing the contract and the remaining balance no less than two weeks before the start of the rental period. 7. If the renter cancels the contract earlier than 4 weeks before the start of the rental period, the owner has the right to keep the advance payment. 8. If the renter cancels the contract in writing later than four weeks but earlier than two weeks before the agreed boarding time, the owner has the right to keep the advance payment and receive compensation of an additional 25% of the rental amount. 9. If the renter cancels the contract in writing later than two weeks before the agreed boarding time, the owner has the right to keep the entire rental amount. - If the owner does not deliver Santana for boarding at the agreed time, or if Santana is not operational for significant parts of the rental period, the renter may receive a price reduction as compensation for the delay. a. A price reduction is granted if boarding cannot take place due to the owner’s delay of more than 4 hours later than the agreed time, and the owner has not offered the renter another vessel that the renter accepts. - The owner has the right to cancel the contract in case of force majeure, if another vessel cannot be provided or if the renter does not accept the other vessel for valid reasons. a. If the contract is canceled, the entire rental amount shall be refunded to the renter. The owner has no further liability. On Board 12. The crew consists of: Skipper Simen Løvgren, tel. 934 44 610 a. It is the skipper’s responsibility, with the help of the renter, to sail Santana. He is solely responsible for navigation and all decisions concerning the safety of the vessel and passengers. 13. Everyone on board has a shared responsibility for order and cleanliness. 14. The owner is only liable for damage or loss caused by gross negligence and/or intent. 15. The renter shall compensate for any loss or damage caused by him or his guests to the owner, vessel, or equipment. Other Provisions 16. If one party wishes to make a claim against the other party, this claim must be made in writing within 14 days after the expiration of the rental contract. After this period, the right to make any claims is forfeited. 17. If one party commits a significant breach of the contract, the other party has the right to immediately cancel the contract. 18. The renter and any guests are required to follow the guidelines given on board Santana. The renter understands that animals, weapons, or narcotic substances are not allowed on board. The renter and any guests also understand that goods brought on board between different nations must be declared, including to Norway. 19. Any disputes related to this contract shall be resolved in accordance with Norwegian law, and the case shall be held in Oslo.
