Recitals - WHEREAS, OWNER is the lawful owner of the 2022 Bentley Navigator 220, Hull ID# BAG07357A222 (hereinafter referred to as the "WATERCRAFT"), which includes all related equipment, fixtures, and other appurtenant property; - AND WHEREAS, CHARTERER desires to charter the WATERCRAFT for personal use along with no more than fifteen (15) guests; Now, therefore, in consideration of the mutual covenants herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows: - Term: The charter term shall commence on [Start Date] and conclude on [End Date]. - Rental Fee: The total rental fee shall be [Total Fee] US Dollars, payable via GetMyBoat.com. A $100 cleaning fee will be deducted from the deposit if the WATERCRAFT is not clean upon return. - Inspection and Condition: - - OWNER confirms the WATERCRAFT is in good mechanical and physical condition. Any known issues will be listed on the Pre-Rental Inspection Sheet. CHARTERER agrees to inspect the WATERCRAFT prior to departure and notify OWNER of any discrepancies. - Damage to Equipment: CHARTERER is responsible for returning the WATERCRAFT in the same condition as received. OWNER may charge for any necessary repairs or cleaning, with costs applied to the credit card on file. - Navigation Limits: The WATERCRAFT is restricted to inland waters. CHARTERER agrees not to navigate beyond designated areas or in adverse weather conditions. Violation of this clause results in CHARTERER's liability for any resultant damage or loss. - Insurance: OWNER will maintain insurance coverage against fire, marine, and collision risks, and for protection and indemnity, during the charter term. CHARTERER is liable for any damages up to the amount of the insurance deductible. Personal effects and optional equipment like dinghies are not covered. - Accidents: CHARTERER assumes risk of loss from their own actions or negligence. In case of mechanical breakdown disabling the WATERCRAFT for over 24 hours, OWNER will pro-rate the rental or provide a suitable replacement. - Liens and Repairs: CHARTERER shall not permit any liens against the WATERCRAFT and is responsible for unauthorized repairs. - Running Expenses: CHARTERER will bear all running costs, such as fuel, docking fees, and provisions. The WATERCRAFT must be returned with a full tank of gas, or a $50 refueling service charge in addition to the cost of the fuel will apply. - Indemnification: CHARTERER agrees to indemnify and hold harmless the OWNER from liabilities for injuries or damages to third parties or property resulting from the charter use. - Swimming and Activities: OWNER and insurers accept no liability for accidents or injuries from swimming or related activities. CHARTERER uses any provided equipment at their own risk. - Restricted Use: The WATERCRAFT is for personal pleasure use only and may not transport merchandise, carry passengers for hire, or engage in any trade. - Assignment and Sub-Charter: CHARTERER may not sub-charter or assign this agreement without OWNER’s written consent. - Cancellations: Cancellations more than 30 days prior to departure result in a full refund less a 7.5% service fee. Within 5 days, a $50 administrative fee also applies. Weather-related changes will be accommodated with alternate dates or pro-rated refunds. Any cancellations within 24 hours of your booking will result in a 50% refund. - Authority and Competency: CHARTERER is competent to operate the WATERCRAFT and agrees not to delegate this responsibility unless to a similarly qualified person. - Entire Agreement: This document embodies the entire agreement between the parties, superseding all prior agreements regarding this charter.
