Kayak Rental Agreement and Waiver The terms set forth shall be binding. The rental of kayaks does not constitute transfer of ownership of said kayaks. If special requests for drop-off/pick-up accommodations are needed, we will do our best to accommodate but can not guarantee fulfillment beyond the accommodations listed in the description. Michigan weather changes quickly and it is important that you check the forecast as no refunds will be issued if inclimate weather rolls in while on the water. We will however, watch closely, and at our discretion, will cancel reservations and issue refunds if the weather is forecasted to ruin anybody’s experience. Life-jackets are to be worn by all minors under 18 years of age at all times while aboard the kayak. Life jackets will be provided and inspected together prior to departure. Those over the age of 18 may choose not to wear the life jacket but doing so is at the discretion and risk of the Renter and no responsibility shall fall upon the owner in regard to loss of property or life as a result of not wearing a life jacket. 10% late charge will apply for late meet-ups 10minutes beyond designated time. 10% fee will apply for no shows. This Kayak Rental Agreement and Waiver (“Agreement”) is entered into between Waves of Fun (“Company”) and the undersigned renter (“Renter”). 1. Rental Terms and Conditions 1.1. The Renter agrees to rent the kayak(s) and related equipment (e.g., paddles, life jackets) provided by the Company for a specified period, as stated in this Agreement. 1.2. The Renter must return all equipment in the same condition as received, less normal wear and tear. Any damages or losses are the responsibility of the Renter. 1.3. The Renter acknowledges that a valid government-issued ID is required at the time of rental. 2. Acknowledgment of Risks 2.1. The Renter understands that kayaking involves inherent risks, including but not limited to capsizing, collisions, drowning, and exposure to natural elements. 2.2. The Renter is responsible for assessing their own physical abilities and comfort with water activities before participating. 3. Safety Rules 3.1. The Renter must wear a properly fitted U.S. Coast Guard-approved personal flotation device (PFD) at all times while on the water. 3.2. The Renter must comply with all local laws and regulations, including restrictions on alcohol consumption. 3.3. The Renter agrees not to paddle in restricted areas or during hazardous weather conditions. 4. Assumption of Risk and Waiver of Liability 4.1. The Renter assumes full responsibility for their safety and the safety of any minors under their supervision during the rental period. 4.2. The Renter releases the Company, its employees, and agents from all liability for any injuries, damages, or losses sustained during the use of the rental equipment. 4.3. This waiver extends to claims of negligence or carelessness on the part of the Company. 5. Indemnification 5.1. The Renter agrees to indemnify and hold harmless the Company from any claims, demands, or damages arising from their use of the equipment. 6. Governing Law 6.1. This Agreement shall be governed by the laws of the state of Michigan. By booking, the Renter confirms acknowledgement and acceptance of the above terms and conditions.
