READ THOROUGHLY - TOP TO BOTTOM! Failure to read and follow directions can result in additional charges or cancellation of your charter! CAPTAIN SERVICE FEE Your booking price includes everything EXCEPT the Captain Service Fee, which is a REQUIRED amount of 20%. Please do your best to collect this for the captain and crew before the end of your charter. Payments to your captain can be made. PLEASE DO NOT stiff your captains, they work very hard to prep for your charter, make sure you are safe, and have a great time with us. If the required amount of 20% is not given to the captain, your card will be charged for the full amount, or the difference, plus processing fees and taxes! Every boat company on Lake Travis follows the same service fee policy, we are no different. RULES - Customer agrees to inform their guests of all rules and regulations pertaining to this contract, on board, and by lessor/crew, and agrees that their guests will abide by all such rules and regulations. If a printed version of this contract is requested, one will be provided at no charge to the customer. Passenger capacity stated for each boat is strictly enforced, and there are no exceptions to exceeding the passenger allowance. We reserve the right to cancel your charter for any reason at any time. No pets are allowed on our boats. For registered service animals specially trained to perform specific tasks for an individual with a disability, please call us prior to booking. Emotional support animals are not allowed onboard. No guns, weapons, or items deemed to be weapons are allowed on board or on the marina premises at any time. No glass onboard, other than liquor or wine bottles. Beer bottles (please purchase beer in cans), wine glasses, champagne flutes, or drinking glasses will not be allowed. No drug use allowed onboard or prior to your charter. Excessive alcohol or illegal substance intoxication will result in immediate termination of your charter. Each guest onboard must electronically sign and agree to our Boat Rental Participant Agreement, Release and Assumption of Risk. No boat will leave the dock without each guest truthfully and fully completing such release. Only contracted captains and employees of are allowed to operate our boats. No guest may operate any boat at any time for any reason. No smoking in the cockpit of any boat. Smoking is allowed on the swim platforms only. No feminine products, paper towels, or any other item not specifically designated as MARINE TOILET SAFE shall be flushed. Any damage to our marine toilet systems as a result of disregarding the proper operation of the marine toilet systems will result in a fine of up to $400 per occurrence. No silly string, glitter or confetti is allowed onboard. For specific decoration requests, please call us in advance. Fighting, verbal abuse, deliberate disrespect, threats, or physical acts of intimidation towards captain, crew, guests, employees or tenants of Paradise Cove Marina, or regardless of whether such violation occurs in the parking lot, on marina premises, on the boat, in the lake, or on the shore, will result in immediate termination of your charter, fines of up to $500, and law enforcement will be called. No explicit language on the boat or on the marina premises, regardless of whom such language is directed. Explicit language may result in termination of your charter and removal from the marina premises. No urinating any place other than the toilet. Any guest deliberately trashing the bathroom will be fined up to $200 per occurrence and charter will be terminated immediately. No jetski rentals are allowed with our boat rentals. If any guest in your party rents a jetski, they will not be allowed to tie the jetski to our boat, and they will not be allowed to board. No tie ups with boats from other companies. This is for the safety of our customers and their guests, as we cannot control the safety or operating procedures of another company. We rarely make exceptions, but if we do, you MUST call us in advance to discuss. These policies may or may not be the full list of policies, and our captains, employees, managers, or owner of reserves the right to implement any policy at any time that we deem necessary to protect our guests, our company property, and the safety of everyone onboard. Any violations of these policies, whether written or implied, will result in immediate termination of your charter, all monies forfeited, no refunds given, fines of up to $500 per occurrence, and under certain circumstances, law enforcement will be called. We reserve the right to deem any act a violation of our policies, even if such violation is not expressly written or implied. Any other damages to property, whether on the marina premises, or onboard our boats, will be charged to the credit card on file for the full replacement value. Inclement Weather Policy: If it is raining at the marina or inclement weather is deemed hazardous by your captain within 30 minutes of your scheduled cruise start time, the charter may be delayed or can be rescheduled within 12 months of the current date. If the captain deems the weather hazardous, Lessee will receive a full refund minus the deposit, plus processing fees and taxes. If it starts raining during the party, the party will continue unless the weather is deemed too severe by the operating captain or owner of The Company, or unless the Lessee (party planner) decides they want to end the party early because of the weather, at which point a prorated refund will be issued. Any party that ends early for any other reason will not receive a refund. Cancellation Policy: Cancellations with more than 21 days advance notice will receive a 100% refund of all monies paid. Cancellations with less than 21 days advance notice, but more than 7 days’ notice, will be allowed to reschedule up to one year from the date of their charter. Rescheduled dates will be subject to any rate increases for future bookings. If the full amount of the booking has already been paid, no partial refunds are given, and any monies paid will go toward a future charter date. Cancellations with less than 7 days’ notice will not be allowed to reschedule and will forfeit 100% of the full charter amount. LESSEE TO READ ALL PAGES OF THIS AGREEMENT In consideration of the agreement herein (hereinafter referred to as the LESSOR) agrees to serve as guide to the undersigned (hereinafter referred to as the LESSEE) and his/her party on a charter cruise for the time period specified at booking. If the lessee or members of the lessee’s party cause the vessel to return to the marina later than scheduled for any reason, the lessee agrees to pay twice the hourly rate as appropriate. The lessee certifies that he/she will comply with all safety rules and regulations as posted and conveyed by lessor and/or crew, and further certifies that he/she has read and understands said rules and regulations. Lessee hereby agrees to the Terms & Conditions and recognizes that the rules and regulations set forth therein are applicable from the time lessee’s group/guests enters the marina parking lot, during their charter event and until the time they exit the parking lot after the charter. Lessee recognizes that the Terms & Conditions are available for review only and are not negotiable or up for discussion under any circumstances. Lessee agrees to take complete responsibility for the actions, behavior, safety, and wellbeing of his/her guests. Lessee understands that it is his/her responsibility to ensure that all of Lessee’s guests are aware and understand the rules and regulations specified in this contract, on board, and by lessor/crew. I, the Lessee, authorize the lessor to charge my account for any damages or loss of equipment, including but not limited to tables, chairs, or other items provided by the lessor and staff throughout the duration of my cruise, including immediately before and after. The Lessee acknowledges he/she has carefully examined the craft and finds it suitable for the purpose for which it is leased, and that other accessory equipment is in suitable and acceptable condition: that he/she will maintain both craft and equipment in a safe, dependable condition while he/she has custody. Lessee acknowledges that it is his/her responsibility for the safety and welfare of other boaters, persons, and passengers. It is AGREED AND UNDERSTOOD BY LESSEE that the lessor shall not be held liable for damages, inconvenience or time lost caused by any accident. Lessor further agrees to indemnify and hold harmless the Lessor and its agents, affiliates and personnel, harmless of and from any and all claims for loss of or damage to property or injury to persons (including death) resulting through the use, operation or possession of said rental craft. Lessee further agrees to hold the Lessor harmless should loss or damages occur to any of Lessee’s (or guest’s) personal property while carried in, or on, the rental craft, including loss or damage by fire, water, theft, or any other causes whatsoever. Lessee understands and acknowledges he/she is solely responsible for the welfare and wellbeing of his/her guests and that swimming/diving etc are at their own risk. Lessee expressly agrees to indemnify and hold Lessor and its agents, affiliates and personnel, harmless of, from and against any and all loss, cost, damages, attorney fee and/or liability in connection with the enforcing of the forgoing rental contract by Lessor, including expense incurred in connection with attempting to collect delinquent payment, and in the event of suit by Lessor, to recover possession of said rental property and/or to enforce any terms, conditions and/or provisions hereof. It is understood and agreed that the venue and any action hereunder shall be in the county of Lessor. Lessor’s ability to provide a rental craft if reserved, is contingent upon and subject to the return of the unit by the previous Lessee, or any other cause beyond Lessor’s control. Lessee understands and accepts that the vessel will return to the Marina up to 30 minutes prior to the contracted end party time to allow for travel time, and to allow guests to vacate the vessel at the allotted end time as stated in the signed lease agreement between the Lessee and Lessor. Lessee acknowledges that any policy violations observed in the parking lot, on marina premises, on board the party boat, or anywhere on the lake or lake shore, may result in fines being assessed or the party being terminated at the sole discretion of the captain, manager or owner with no refund. Should any term or condition of the Rental Contract be held void or unenforceable then that term shall be deemed severed from this Contract and the remainder shall not be affected and will remain in full force and effect. WARNING: There are significant elements of risk in any adventure, sports, or activity associated with the outdoors, the presence of use of motorized watercraft and activities on, in and around the water. Certain risks cannot be eliminated without destroying the unique character of the activity. EXPRESS ASSUMPTION of RISK and RESPONSIBILITY: I/We assume the risk(s) of personal injury, accidents and/or illness, including but not limited to sprains, torn muscles and/or ligaments, fractures, eye damage, cuts, wounds, scrapes, abrasions and/or contusions; dehydration, drowning, exposure; head, neck and/or spinal injuries; bites, stings and/or allergic reactions; shock, paralysis or death. I/We agree to assume responsibility for the risks identified above and any risk not specifically identified. My/Our participation in this activity is purely voluntary. I/We verify that I/We are physically fit, not under the influence of drugs or alcohol and sufficiently qualified and capable of participating in these activities. Therefore, I/We assume full responsibility for myself, including any minor children, for which I/We are responsible, for bodily injury, accidents, illness, death, loss of personal property, and expenses thereof as a result of any accident that may occur. I/we elect to participate in spite of the risks. RELEASE: In consideration of the services or property provided, I/We for myself and any minor children for which I/We are responsible, and heirs, personal representatives or assigns agree that: its principles, directors, officers agents, and employees shall have no liability of any nature for any and all damage to me and other persons or property as a result of any acts, omissions, or negligence of or any other person or entity and I/We hereby release and discharge and insurer, if any for any such damage.
