All drivers must have a valid Pleasure Craft Operators Card (Boaters License) with them AND have experience driving a boat or jet ski. The company reserves the right to refuse any renter who does not have adequate experience. Rentals that are cancelled for failing to provide their own qualified driver forfeit their deposit. Minimum rental age is 21, with a valid driverās license and Pleasure Craft Card. Daily rentals are from 9am to 5pm. Multi-day rentals starting at 9am on the first day and conclude at 5pm on on the last day. HST and gasoline are not included in the rental rates. Transport Canada safety equipment is included in rental (paddle, lifejackets, safety kit, etc.). In cases where a boat is unavailable due to maintenance or repairs, The company reserves the right to switch your reservation to another boat, reschedule your rental date, or to cancel the reservation without penalty. Our service department is available to do service calls when any issues with the boat or jet ski arise throughout the rental. Any defects found to be the fault of the renter (eg. dead battery, out of gas) will be charged to the renter at a rate of $100/hr. Tickets for violations are the responsibility of the renter. Delivery is included to boat launches in Muskoka. See our Delivery Map for a list of launches. Unless otherwise arranged, rentals will be delivered at 9:00am on the rental date. Renters should plan to return the vessel to the same location at 5:00pm. Renters should arrive for pick up and return promptly. Renters who fail to return their vessel on time will incur a fee of $100/half-hour. Rented vessels are expected to be returned in reasonably clean condition. Wipes, paper towels, and cleaning supplies are provided with each rental. Vessels should be wiped down to remove any dirt, debris, sun screen oils, or other contaminants from the vesselās interior and upholstery. Vessels returned in unreasonably soiled condition will be charged a $400 detailing fee. Deposits are refundable on cancellations of multi-day rentals 21 daysā notice. Less than 21 days, deposits are not refundable. Deposits are refundable on cancellations of single day rentals with seven daysā notice. Less than seven days, deposits are non-refundable. Deposits are not refundable for inclement weather; ie, lighting, high winds, long lasting heavy rains. Rentals may be rescheduled without penalty for inclement weather. Waiver of Liability: To the fullest extent permitted by law, the Participant hereby releases, waives, discharges, and covenants to hold harmless to the company, its directors, officers, employees, volunteers, agents, assigns, and executors from any and all liabilities, claims, demands, losses, or damages caused or alleged to be caused in whole or in part by the negligence of the company or otherwise, including negligent rescue operations. Indemnification: The Participant agrees to indemnify and hold harmless to the company from any and all claims, actions, suits, costs, expenses, damages, and liabilities, including attorneyās fees, arising out of, connected with, or resulting from the Participant's participation in watercraft rental activities, including those resulting from the negligence of the company Physical Fitness: The Participant asserts and certifies that they are physically fit and sufficiently trained to handle the physical and mental requirements of watercraft operation in which they will participate. The Participant has not been advised against participating in such activities by a healthcare professional. Safety Equipment and Instructions: The Participant agrees to wear all required safety equipment and to follow the safety instructions and guidelines provided by the company or its employees. This includes, but is not limited to, the proper use of life jackets, adherence to specific watercraft operating instructions, and compliance with local waterway laws and regulations. Acknowledgment of Risks: The Participant acknowledges that watercraft activities, including but not limited to boating, kayaking, canoeing, paddle boarding, water skiing, wakeboarding, wake surfing, and jet skiing, inherently involve significant risks of physical injury, property damage, and even death. These risks may arise from the Participantās actions, the actions of others, or the uncontrolled natural environment. Nature of the Risks: Risks may include, but are not limited to, drowning, collisions, capsizing, sinking, falling overboard, injuries from watercraft operation or towed water sports, exposure to weather conditions, hypothermia, heat stroke, sun burn, and equipment failure or malfunction. Acceptance of Risks: By participating in watercraft rental activities, the Participant voluntarily assumes all risks, both known and unknown, associated with these activities, even if arising from the negligence of the company or others, and assumes full responsibility for their participation.
