Overview It is the responsibility of the Lessee/Operator of the rental boat to heed all weather advisories & small craft warnings issued by the National Weather Service while the rental boat is in his/her possession, to keep him/herself & others safe. No refunds will be issued with regard to inclement weather, winds, non-use, or Lessee/Operator relinquishing the boat early before the end of the rental period. Boat owner reserves the right to cancel this agreement due impending weather affecting the immediate Lake Saint Clair area. You acknowledge that You have read, understand & agree with all the terms and/or conditions as set forth in this Rental Agreement. You certify that you and your passengers will not smoke aboard the vessel at anytime. Cigarette burns or smoke damage will result in loss of your security deposit in full. You certify that you are an experienced operator of outboard motors and pontoon boats for more than 2 years. You familiarized yourself with a nautical chart of the area in which the equipment is to be used.  You have never been cited for unsafe boat operations, nor have you had an accident upon the water. Navigational Limitations: You will not remove any equipment from the water, and I agree to restrict the operation of the boat rented to the following described area: Anchor Bay/Lake Saint Clair.  Overloading of the boat, water skiing, towing, operating the boat while impaired, possession of contraband, illegal activities and/or night operation (after sunset & before sunrise) of the rental boat is strictly forbidden. Upon violation of these terms, Lessee will lose possession of the boat & agrees to pay for the full term of the Rental Agreement plus any and all charges as agreed.  If not fully fueled we will fuel the boat ourselves and charge you the current price of gasoline plus the $50.00 fuel surcharge.  Michigan Legislature 324.44522: “A person who rents a personal watercraft from a boat livery is liable for any injury resulting from the negligent operation of the personal watercraft, whether the negligence consists of a violation of the statutes of this state, or the failure to observe the ordinary care in operation required by the common law.” You certify that you have read Michigan Legislature 324.44522, understand and agree to the charges as invoiced and to terms and conditions of this Rental Agreement. Failure to return rental property and/or rental equipment upon expiration of the rental period and/or failure to pay all amounts due  (including costs for damage to the rental property and/or equipment) are evidence of abandonment and/or refusal to to redeliver the property, punishable in accordance with Michigan Legislature 324.80130f. You certify that you have read and understand this statement.  ***Stop the Boat - before proceeding under any bridge and/or shallow water as serious damage to the boat will result. Lessee is responsible for all damage.  You are responsible for any and all citation(s) incurred during the operation of the rental boat. You are aware of “no wake” & “idle speed” rules. You are aware of the safe operating speeds for this boat with regard to conditions when underway & that responsibility for any and all damage to this boat, other boats, other personal property & persons is the sole responsibility of the renter.   You acknowledge receipt of the boat, motor, & equipment and will return rental property in the same condition by the end of the rental period. If returned late, damaged, dirty, fuel tanks not full, and/or lost/missing items, You agree to pay the Rentals additional charges on demand or thereafter as listed: Late Fee  100 per half hour, Cleaning Fee $100, Cost of fuel needed to fill tank plus Fuel surcharge $50, Boat equipment listed.
