Cancellation Policy for Luxury Yacht Charters Yacht Name: Saint Yacht Length: 88 ft Operator: Anette Charters Purpose: This cancellation policy is designed to protect both the client and the yacht owner/operator in the event of unforeseen circumstances. It outlines the terms and conditions under which the reservation may be cancelled or modified. Defining Events: The following events are considered "Force Majeure" or "Acts of God" and may result in cancellation or modification of the charter: - Severe Weather: A severe weather warning, including but not limited to: - - Hurricane, typhoon, or tropical storm - Heavy thunderstorms or strong winds - Extreme heat or cold - Yacht Damage or Maintenance: Any unforeseen damage or required maintenance to the yacht that renders it unfit for charter - Government Restrictions: Any government-imposed restrictions or prohibitions on charter operations - Health or Safety Concerns: Any health or safety concerns affecting the client, crew, or yacht, including but not limited to: - - Illness or injury to clients, crew, or yacht staff - Pandemics or contagious diseases - Natural Disasters: Any natural disasters, including but not limited to: - - Earthquakes, tsunamis, or volcanic eruptions - Floods or landslides - Other Unforeseen Circumstances: Any other circumstances beyond the control of the yacht owner/operator, including but not limited to: - - Wars, civil unrest, or terrorism - Strikes or labor disputes affecting the charter Cancellation Terms: If a defining event occurs, the yacht owner/operator reserves the right to cancel or modify the charter as follows: - Cancellation: - - If a defining event occurs within [X] days of the charter start date, the client may elect to cancel the charter and receive a full refund of all payments made. - If a defining event occurs after the charter start date, the client may elect to cancel the charter and receive a pro-rata refund of all payments made, up to [X]% of the total charter fee. - Modification: - - If a defining event occurs, the yacht owner/operator may modify the charter to mitigate the impact, including but not limited to: - - Rescheduling the charter to a later date or alternative location - Reducing the charter duration or changing the itinerary Refund Policy: In the event of cancellation or modification, the client may be eligible for a refund as outlined above. Refunds will be issued within 30 days of the cancellation or modification notification. Insurance: The yacht owner/operator has liability insurance that covers unforeseen circumstances, including but not limited to: - Trip cancellation or interruption - Trip delay - Property damage or loss Acknowledgement: By booking a charter on the 88ft yacht, the client acknowledges that they have read, understood, and agreed to the cancellation policy outlined above. The client understands that unforeseen circumstances, including but not limited to those outlined above, may result in cancellation or modification of the charter. Amendments: This cancellation policy is subject to change without notice. Any amendments or updates to this policy will be posted on the yacht owner/operator's website and/or provided to the client upon request. Governing Law: This cancellation policy shall be governed by and construed in accordance with the laws of Turks and Caicos Islands. Any disputes arising from the cancellation policy shall be resolved through binding arbitration in accordance with the rules of Turks and Caicos Islands.
