Renter agrees to refuel vessel at nearby gas station or pay $50 for refueling service as well as the cost of fuel. Late return (after dark) is not allowed, but should it occur it is an additional $100/hour after sunset (by www.timeanddate.com), minimum charge $150. I understand that due to unforeseen inclement weather, I may be required to return the rented equipment immediately by HomePort Rentals (“HomePort”). I have the required license or boater safety certification and agree to operate HomePort equipment in compliance with all laws. I understand that I am responsible for the return of all rental equipment in the same state in which I received it. I agree to pay in full for any repairs or replacement if the equipment is damaged or lost, and/or a retrieval fee if HomePort has to retrieve rented property. I agree to follow all instructions provided by HomePort personnel. I understand that Homeport Rentals is in not responsible for my safety or my belongings including vehicles. BEFORE LEAVING PORT I WILL INSPECT VESSEL AND BY ACCEPTING IT I WARRANT THAT IT IS IN PROPER ORDER. I understand that I will need to read and sign the Waiver and Release of Liability form on the reverse of this agreement prior to commencing my rental usage with HomePort. I am of lawful age and legally competent to sign this agreement. I understand that this agreement is a contract, and hereby certify that I have fully informed myself of the contents of this agreement in its totality. I further certify that I have read the Rules & Regulations, and agree to abide by same. Renters Printed Name Renter’s Signature Date In consideration of the agreement herein, HomePort Rentals, Inc. (“HomePort”) agrees to lease to the Renter, the craft and equipment described herein, only upon the following terms and conditions set forth herein as signed by the Renter below, and signed in full on the front of this document. In consideration of being allowed to rent the equipment as stated in this agreement, I the undersigned have read, and freely and voluntarily agree to the following terms on behalf of all guests in my party: a) The risk of injury operating boats and fishing can be significant, including the permanent paralysis or death. b) I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF HOMEPORT RENTALS OR OTHERS, AND ASSUME FULL RESPONSIBILITY FOR MY PARTICIPATION. c) From release of vessel to renter until it’s return to owner, renter agrees they operate vessel as owner. Renter agrees to return vessel to owner free of any liens or burdens which could be attached during renter’s possession, renter accepts any such obligations as their own and not of the vessel. Renter agrees to assume any liens or burdens attached during possession of vessel by renter. Renter agrees if a HomePort agent is on board at any time the renter continues to serve as captain in command even if HomePort agent is at the helm. Except for by separate agreement, renter understands HomePort Rentals or their agents is not providing qualified training or captain service. d) I, FOR MYSELF AND ON BEHALF OF MY HEIRS, PERSONAL REPRESENTATIVES AND NEXT OF KIN HEREBY RELEASE, INDEMNIFY AND HOLD HARMLESS HOMEPORT, ITS OFFICERS, AGENTS, OTHER PARTICIPANTS, SPONSORS, ADVERTISERS, OWNERS AND LESSORS OF PREMISES, FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES AND LIABILITY ARISING OUT OF OR RELATED TO ANY INJURY, DISABILITY OR LOSS OF LIFE THAT OCCURS, OR LOSS OR DAMAGE TO PERSON OR PROPERTY, WHETHER ARISING FROM THE NEGLIGENCE OR FROM CONTRACT OR FOR FROM TORT, OF HOMEPORT, THEIR STAFF OR OTHERWISE. e) I acknowledge that changing water flow, currents, wave action and wakes from other boats may pose a risk. f) I acknowledge that there is a risk of falling while entering/exiting the vessel. g) I acknowledge that collisions with other participants, watercraft and manmade or natural objects may occur. h) I acknowledge that wind, inclement weather, lightning, weather and temperatures may pose a risk. Do not stay in the water in the event of thunder or lightning. i) I acknowledge that there is a risk of capsizing, sinking, injury, exposure to the elements, and drowning j) I acknowledge that there is a risk of heat/sun related injuries or illnesses. Rules and Regulations Vessel rentals are at your own risk. HomePort and staff are not responsible for personal injury or loss of property. Participation in boating activities may be dangerous. Management reserves the right to refuse rental. Vessel and equipment must be returned by agreed time; additional charges of $50 per hour will begin 30 minutes after agreed time, minimum 1 hour charge. Renters are responsible for safety of all guests and safe conduct of vessel around other vessels, persons and property. US Coast Guard regulations require that life jackets (PFD’s) must be worn by minors on deck at all times when a vessel is underway. Please make sure you have drinking water, bug spray and sun protection. Please dispose of litter in trash cans at end of trip. Renter will be required to reimburse HomePort for all damaged or lost equipment. Reimbursements will be at replacement costs. Renter is required to return vessel in clean condition. Vessels returned dirty will be cleaned professionally by Ann Miller Marine Detailing and bill will be charged to renter.
