This document outlines the terms and conditions of a yacht charter agreement, including the responsibilities of the crew, captain, stewardess, and clients, as well as details regarding complaints, compensation, and legal remedies. Here's a breakdown of the key points: 1. **Certification and Compliance**: The crew must comply with Croatian laws and regulations, and the captain must ensure compliance with the laws of any country the yacht enters. 2. **Captain's Authority and Responsibilities**: The captain is responsible for managing and operating the yacht, ensuring safety, and may refuse orders that endanger the yacht or breach the agreement. The captain may terminate the charter if the client or guests fail to comply with the terms, with no refund to the client. 3. **Stewardess Responsibilities**: The stewardess is responsible for housekeeping, serving, meal preparation, laundry, cabin preparation, and maintaining the bar and drinks stock. 4. **Client Use of the Yacht**: The client agrees to use the yacht for pleasure only, comply with laws, ensure no pets are brought on board without consent, and settle any expenses. Possession or use of illegal drugs or weapons can lead to immediate termination of the charter. 5. **Maximum Number of Persons / Responsibility for Children / Health**: The captain must not exceed the maximum number of guests allowed on board. The client is responsible for the safety, conduct, and entertainment of children and warrants the medical fitness of all party members. 6. **Advanced Provisioning Allowance (APA)**: An APA is collected to cover expenses during the charter. The captain manages expenses and provides receipts, with any excess or unused APA refunded or charged to the client. 7. **All-Inclusive Yacht Charters**: All-inclusive charters cover the yacht, crew, fuel, meals, and standard bar. Additional costs may include communication, dockage fees, fine wines, crew gratuity, and other expenses not included in the charter fee. 8. **Complaints**: Clients can lodge complaints if unsatisfied with the service, but must do so upon check-out with relevant documentation. The company will respond within a specified timeframe, and unresolved disputes may be subject to legal proceedings under Croatian law. 9. **Legal Remedy**: Clients dissatisfied with the resolution of a complaint may pursue legal action, with disputes handled in the Court in Split under Croatian law. Overall, the document ensures clarity and sets expectations for both the charter company and the clients regarding their respective roles, responsibilities, and rights. **Charter Agreement** **1. Vessel Condition** For the agreed period of the charter, it is guaranteed that all charter vessels are in good condition, and their machinery is in proper working order. Legal Relationship Establishment The person confirming the reservation or making the advance payment (referred to as the Client) establishes a legal relationship with the company, thereby accepting the General Terms and Conditions. Everything defined by these conditions represents a legal obligation for both the Client and the company. These conditions serve as the basis for resolving any disputes that may arise between the Client and the company. Agreement to Let and Hire The company agrees to let the Yacht to the Client and not to enter into any other Agreement for the Charter of the Yacht for the same period. The Client agrees to hire the Yacht and shall pay the Charter Fee, the Advance Provisioning Allowance (APA), and any other charges as specified. Delivery At the beginning of the Charter, The company shall deliver the Yacht to the Port of Delivery. The Client shall take delivery in full commission and working order, seaworthy, clean, and in good condition throughout. Re-Delivery** The Client shall re-deliver the Yacht to BASE MARINA IN SPLIT to the company. Any expenses incurred during the Charter Period shall be the Client's responsibility. Early re-delivery does not entitle the Client to a refund of the Charter Fee. Mobilization of the Yacht for "Force Majeure"** If during the charter period the yacht cannot move due to "force majeure", no compensation is provided except at the discretion of the company. The Captain may decide to stay in a shelter if the weather forecast is unfavorable, and such decisions are made at the Captain's responsibility. Cancellation Conditions** Cancellation by the Client:** Cancellation fees apply based on the timing of cancellation. The Client may find a third person to assign the Charter Agreement, in which case a refund may be applicable. Cancellation by the company:** the company will provide a full refund if cancellation occurs prior to one month before traveling. Within one month, a credit for future yacht travel will be provided. The Client has the option to cede their rights and obligations to another person. Failure to do so will result in non-refundable cancellation costs as follows: - For cancellation after booking confirmation, 20% of the charter price. - For cancellations 2 or more months before the charter date, 30% of the charter price. - For cancellations more than 1 month but less than 2 months before the charter date, 50% of the charter price. - For cancellations within the last month before the charter date, 100% of the charter price. However, if the cancellation is due to the following reasons: - The death of an immediate family member. - Hospitalization due to serious injury. - War in Croatia. - State Department Travel Warning. - Global pandemic. The received deposit will be retained; however, the charter agency will offer the Client a yacht during another period within the current season, the following season, or such time as the issue has been resolved.
