Jet Ski Adventures on Lake Michigan & Duck Lake!

The terms set forth shall be binding. The rental of kayaks does not constitute transfer of ownership of said kayaks. If special requests for drop-off/pick-up accommodations are needed, we will do our best to accommodate but can not guarantee fulfillment beyond the accommodations listed in the description. Michigan weather changes quickly and it is important that you check the forecast as no refunds will be issued if inclimate weather rolls in while on the water. We will however, watch closely, and at our discretion, will cancel reservations and issue refunds if the weather is forecasted to ruin anybody’s experience. WAIVER OF LIABILITY, RELEASE, AND INDEMNIFICATION AGREEMENT JET SKI RENTAL AGREEMENT THIS DOCUMENT CONSTITUTES A LEGALLY BINDING AGREEMENT. BY SIGNING THIS AGREEMENT, THE UNDERSIGNED ("RENTER") HEREBY ACKNOWLEDGES AND AGREES TO THE TERMS AND CONDITIONS SET FORTH HEREIN. READ CAREFULLY BEFORE SIGNING   1.      DEFINITION OF RENTER For the purposes of this Agreement, the term "Renter" shall refer to the individual or entity renting the equipment for any period of time, whether directly through the Owner or via any third-party platform.   2.      ASSUMPTION OF RISK The Renter expressly acknowledges and agrees that the operation and use of jet skis entail inherent risks, both known and unknown, which may result in bodily injury, property damage, or death. The Renter further acknowledges that they possess the necessary training, skills, and/or experience to safely operate the jet ski and any related equipment. The Renter hereby voluntarily and unequivocally assumes all risks associated with the operation and use of the jet ski and any related equipment, regardless of the nature or cause of such risks.   3.      RELEASE AND WAIVER OF LIABILITY The Renter, on behalf of themselves, their heirs, executors, administrators, assigns, and personal representatives, does hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the owner of the jet ski and all affiliated entities, employees, agents, and representatives ("Owner"), from and against any and all claims, demands, actions, damages, or causes of action arising out of or related to any injury, loss, or damage, including but not limited to injury, loss, or damage caused by the negligence of the Owner or any third party.     4.      INDEMNIFICATION AND HOLD HARMLESS The Renter agrees to DEFEND, INDEMNIFY, AND HOLD HARMLESS the Owner from and against any and all claims, damages, losses, costs, liabilities, and expenses, including reasonable attorney's fees, arising out of or related to: a.      the actions, damages, and costs incurred by any individuals within the Renter’s group or party during the rental period, including, but not limited to, damages to the equipment, property, or injuries to third parties resulting from the actions of any group members. b.     Any and all damages to the jet ski and/or related equipment during the rental period, beyond normal wear and tear; c.      Any injury or property damage caused to third parties or their property as a result of the Renter's operation or use of the jet ski; and d.     Any violation of applicable laws, rules, or regulations by the Renter during the rental period.     5.      ACCEPTANCE OF EQUIPMENT The Renter hereby acknowledges receipt of the jet ski and any related equipment in good and functional condition, and accepts full responsibility for the care, custody, and control of the equipment during the rental period. The Renter further agrees to return the equipment in the same condition as received, ordinary wear and tear excepted.   6.      SHORELINE PROXIMETY REQUIREMENTS The Renter and any individuals in their group agree to remain within a distance from shore that allows for clear visibility of the shoreline at all times. Under no circumstances shall the jet ski(s) or any rented equipment be operated more than 0.5 nautical miles from the shoreline when operating on any portion of Lake Michigan. The Renter acknowledges that this requirement is a safety measure that protects both parties and mitigates higher risks.   7.      NO WARRANTIES The Owner makes no warranties, express or implied, regarding the suitability, condition, or fitness of the jet ski and related equipment for any purpose. The Renter accepts the equipment "AS IS" and assumes all responsibility for its use. 8. GOVERNING LAW AND VENUE This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan. Any disputes arising from or related to this Agreement shall be resolved exclusively in the courts of Muskegon County, Michigan.   9. ENTIRE AGREEMENT This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof, and supersedes any and all prior or contemporaneous agreements, whether oral or written. No amendment, modification, or waiver of any provision of this Agreement shall be binding unless set forth in writing and signed by both parties. BY RENTING THE VESSELS, THE UNDERSIGNED ACKNOWLEDGES AND AGREES THAT THEY HAVE CAREFULLY READ AND FULLY UNDERSTAND THE TERMS OF THIS AGREEMENT, AND THAT THEY ARE VOLUNTARILY EXECUTING THIS DOCUMENT WITHOUT DURESS OR COERCION.
