WAIVER We are a limited liability company incorporated and established in and under the laws of Wyoming, United States. THE UNDERSIGNED, FOR HIM/HERSELF AND ALSO FOR THE MINOR(S) MENTIONED BELOW (if any), by signing this document, declares to have read it pror to the signing thereof and to have irrevocably agreed to and accepted the following terms and conditions and to have irrevocably provided the following indemnitications and waivers I understand and accept that this waiver and all obligations, relationships and occurrences contained herein and/or referred to herein and/o relating hereto and all of the activities listed herein and/or conducted in relation thereto, are EXCLUSIVELY GOVERNED BY THE LAWS OF Wyoming, United States and I HEREBY IRREVOCABLY AGREE TO SUBMIT ANY AND ALL MATTERS IN RELATION HERETO TO THE EXCLUSIVE JURISDICTION OF THE COURT IN FIRST INSTANCE OF Wyoming. I understand that there are inherent risks involved with participating on one of the Boat trips with us or with chartering our boat, including but not limited to equipment failure, perils of the sea, acts of other participants, and adverse sea and weather conditions. and hereby assume such risks I UNDERSTAND THAT I HAVE THE DUTY TO EXERCISE REASONABLE CARE FOR MY OWN SAFETY AND I AGREE TO DO SO. I hereby affirm that I understand the inherent dangers of sailing, fishing, swimming, snorkeling and diving; and I understand that reference to any ot fishing, swimming, snorkeling and/or diving activity does not imply or guarantee that such activity can take place. | hereby agree to heed at all times the advice and instructions of persons of the company and to practice common sense water safety procedures I hereby agree to irrevocably and forever discharge, release, indemnity and hold harmless each of the company and/or their owners, directors, employees, agents, crew and/or other associated personnel and/or -persons and any rescue agency in Curaçao and the country of Curaçao, from any and all responsibilit and/or liability for any and all harm, injury, death, loss or damages (physical, mental, or monetary), and/or if I am injured as a result of ANY problems (medical, accidental or otherwise, including, without limitation, negligence), all of the aforementioned regardless of fault or negligence, which may befall me while participating on one of the boat trips of the company and/or with chartering a boat or while using any facilities related thereto. I hereby irrevocably agree NOT to make a claim against or sue any of the above parties for any of the aforementioned matter including but not limited to injuries or damages, whether (without limitation) they arise or result from any negligence or other liability. I further specifically agree to indemnify and hold harmless the released parties for any and all causes of action arising as a consequence of any incidents which might occur as a consequence of my participation in any fishing, swimming, snorkeling and/or diving activity with or involving the released parties. The releases in this paragraph shall be binding upon my family, heirs and assigns, and administrators I assert that I am physically fit to ride on a boat. I agree that if I participate with any swimming and/or snorkeling and/or diving activity, that by participating I have declared that I can swim, and that I have the skills to snorkel and/or dive in the open ocean with no assistance. If I cannot swim, I agree to remain on the catamaran at all times. I also agree that I will not expect the staff to teach me how to fish, swim, snorkel or dive and that prior to performing such an activity will have the skills necessary to participate without assistance I fully understand that the company have limited medical facilities and that in the event of illness or injury, appropriate care must be summoned by radio and treatment will be delayed until I can be transported to a medical facility. I agree in advance to these conditions The company has made no representations to me, implied or otherwise, that they or their crew can or will perform safety rescues or first aid. I declare that in the event I show signs of distress or call for aid, I would like assistance and will not hold Salty Skin BT and/or their crew or passengers, responsible for their actions in attempting the performance of rescue or first aid. I authorize the company to, and I declare that I will, reimburse for the loss or breakage of any and all its equipment at the current replacement value and also for damages incurred while transporting the equipment. I HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE IRREVOCABLY BOUND BY IT, FROM THE DATE OF MY SIGNATURE, FOREVER INTO THE FUTURE
