Renter MUST have a valid safe boater certificate AND proven experience operating center console vessels. Operating this vessel intoxicated or under the influence of drugs or alcohol will immediately void the rental - please operate safely. Food, drink, chemicals, etc that are known to permanently discolor or damage the boat in any way are forbidden. Prime examples: red wine, Cheetos/Doritos/Orange Dust-style snacks, loose tobacco, lit cigarettes/cigars and any others at the discretion of the owner/operator. If any forbidden consumables are discovered a $300 additional fee will be assessed for cleaning, no exceptions. Rental includes the boat, transporting to agreed pickup/drop-off location(s), fuel is separate, additional amenities as agreed upon, captain and crew, disbursed separately to conform to bareboat regulations. Although the operator will do their best to create an amazing day for the renter, a rental does not include any guarantee of experience (for example: seeing marine life, ideal weather, flat water, access to specific destinations, activities, etc.) Renters assume temporary ownership of the vessel and *all* liability for any damage, injuries, additional fuel requirements, cleaning, repair, replacement parts and towing should the need arise. Liabilities incurred in-excess of the deposit will be expected to be paid immediately at retail costs. Rentals start at the time approved by renter/owner whether the boat is underway or not. Extending the time allotted due to renter lateness should not be assumed and is determined at the sole discretion of the operator and boat owner. Any extension of time must be agreed upon at the discretion of the operator/owner and paid for as agreed. Renters who are unable to swim may be required to wear a life jacket. If any guests cannot swim, please inform the operator before going underway. At the discretion of the operator or boat owner, renters with a disability that is deemed unsafe for boating may be asked not to participate in the rental. Please discuss any before the cancellation window. Any guest who is not able to embark/disembark from the dock to the boat unassisted will not be permitted to board as a safety benchmark. Disorderly, unruly, intoxicated or aggressive renters may be asked to disembark early at an unplanned stop/location for the safety of other renters and the operator and will be required to obtain transportation at their own cost. Similarly, at the discretion of the operator, rentals will be aborted early for safety reasons without refund. Guardians of children must provide their own appropriately-fitting, approved life jacket for any children under the age of 6 as per USCG regulations and are responsible for ensuring compliance: A child under the age of 6 must wear a USCG-approved Type I, II or III personal flotation device while onboard a vessel under 26 feet in length while the vessel is underway. "Underway" is defined as anytime except when the vessel is anchored, moored, made fast to the shore or aground. Groups bringing supervision-required children must be majority adult (for example, 5 adults, 3 children is OK. 3 adults, 5 children is NOT OK) and are responsible for actions and safety of their children while underway. Cancellations inside the no-refund window are at the discretion of the boat owner only, and may include a full or partial refund for factors including non-traversable seas, high wind, extreme weather (including lightning, tornadoes and hurricanes), personnel or mechanical issues, or other reasons not described. Rain, inclement weather, inaccessibility to a location or event or activity for any reason are not acceptable factors for cancellation with refund.
