We had a great lake day thanks to Brandin! He was very accommodating, and made our rental process very easy. His boat was set up with all the amenities we could have possibly needed for a perfect day. The boat came with a great sound system, spacious cooler, a fun and easy to use splash pad, enough life jackets for the entire group, and even a grill! Communicating with him was a breeze. We will definitely be booking with him again, I highly recommend.

Deposit: A deposit of $700 is required to cover damages or cleanliness. Terms and Conditions: Assumption of Risk: · The Renter hereby acknowledges and assumes all inherent risks associated with the activities for which the Boat is intended, including but not limited to the risk of bodily injury and/or fatality. Acceptable Use: · The Renter agrees to act as the exclusive operator of the boat and to exercise utmost care, diligence, and responsibility in its operation. · The Renter shall at all times adhere to the rules and regulations stipulated by the Boat Owner and comply with all pertinent laws and regulations governing maritime activities. · The Renter bears full responsibility for the safety and well-being of all passengers aboard the Boat. For comprehensive information and frequently asked questions regarding boater education, please refer to https://tpwd.texas.gov/fishboat/boat/ Prohibited Activities: · The operator of the vessel must abstain from the consumption of alcoholic beverages and remain sober throughout the entire duration of the rental period. · Tying up to other boats is categorically forbidden. The Lessee is expressly prohibited from attaching or securing the rented boat to any other watercraft without prior authorization from the Lessor. · The Lessee is strictly prohibited from docking or beaching the boat. The engine may be turned off; however, the vessel must remain in open water at all times during the rental period. Any deviation from this requirement constitutes a breach of the rental agreement. · The introduction of glass bottles onto any of our boats is strictly forbidden. Furthermore, the presence of red wine specifically is explicitly prohibited. In the event that red wine is discovered aboard the boat, it shall be considered a breach of the rental agreement, resulting in the immediate forfeiture of the security deposit held by the Lessor. Children: · For safety reasons, children who are under the age of 12 are required to wear a life jacket at all times while they are on board the boat. This rule is in place to ensure the protection and well-being of young passengers, especially in potentially risky situations like being on the water. Unsafe Use: · In the event that the Boat Owner determines the Renter's use of the Boat to be unsafe or hazardous, the Boat Owner reserves the right to terminate the rental agreement immediately. · In such cases, the Renter shall forfeit their security deposit without entitlement to a refund. Security Deposit: · Upon confirmation of booking, a security deposit totaling $700 shall be authorized to serve as a safeguard against potential damages or extraordinary cleaning requirements incurred during the rental period. This deposit is designed to cover a spectrum of scenarios, including but not limited to instances involving the presence of vomit or food ground into the boat's interior. It is essential to underscore that the authorization of the security deposit does not equate to an immediate charge to your credit card. Rather, it stands as a precautionary measure, ensuring financial coverage in the event that damages occur. Rest assured, your card will only be charged if damages are incurred during the course of the rental agreement. Late Return Policy: · It is essential for the Renter to adhere to the specified return times. The Renter must ensure that the boat is returned 15 minutes prior to the end of the rental period to facilitate the disembarkation process. In the event of a late return beyond the scheduled return time, the Renter shall incur a charge of $50, with subsequent charges of $50 for every 15-minute interval thereafter. This policy is strictly enforced to uphold operational efficiency and mitigate any inconvenience to subsequent renters. Cancellation Policy: · Cancellation requests must be submitted with a minimum of 20 days' notice from the reservation date to be eligible for a rain check for an alternative booking. Rain checks are applicable only for reservations occurring Monday through Friday within the same calendar year; any rain check requests beyond this timeframe will be deemed expired. Cancellations made with less than 20 days' notice shall not warrant a refund or rain check, unless supported by verifiable evidence of extenuating circumstances. The Renter bears full responsibility for verifying their reservation dates prior to initiating a cancellation. Damage, Liability, and Insurance: · The Lessee assumes full responsibility for any loss of or damage to the Equipment during the rental term, irrespective of fault. · The Lessee agrees to indemnify and hold harmless the Lessor from any and all claims arising from the use of the Equipment. Accident, Breakdowns, Upset, Indemnity, and Release: · In the event of an accident or mechanical breakdown, the Lessee must promptly notify the Lessor and cooperate fully with any ensuing investigations. · The Lessee hereby waives, releases, and holds harmless the Lessor from any claims arising from the use of the Boat. Refund & No-Show Policy: · Refunds shall not be issued for early returns or cancellations attributed to inclement weather conditions. Cancellations must be formally communicated to the Lessor with a minimum of 20 days' notice preceding the scheduled rental period. Failure to provide such notice will result in the imposition of a "No Show" fee. 12. Weather Policy: · Cancellation due to heavy rain or lightning is permissible, excluding forecasts indicating the possibility of such conditions. Tours may proceed in light rain; however, light scattered rain shall not warrant cancellation. Forecasts extending beyond 7 days shall not be considered grounds for cancellation. Only a 12-hour forecast from the commencement time of the charter shall be deemed acceptable for cancellation considerations, with rain checks applicable solely for bookings occurring Monday through Friday within the same calendar year. Return Policy & Late Fee: · The Lessee is hereby mandated to adhere to a strict ending protocol, it is incumbent upon the Lessee to return the boat with a 15-minute buffer at the conclusion of the rental period, thereby facilitating an efficient transition for subsequent renters. · In the event of a failure to adhere to the prescribed return time, the Lessee shall be subject to a late fee. This late fee, amounting to $50, will be levied for any delays beyond the designated return time. Subsequent late fees shall be assessed at 15-minute intervals thereafter until the boat is returned. · It is imperative that the Lessee recognizes and complies with these stipulations, as failure to do so may result in financial penalties and may incur additional liabilities. Cleaning Fees: · In the event that rental items are returned in a condition deemed unsatisfactory, the Lessee shall bear responsibility for the imposition of a cleaning fee. This fee is designed to cover the costs associated with restoring the rental items to their original state of cleanliness and condition. For instances where the need for cleaning arises from severe circumstances, particularly those involving bodily fluids, the Lessee shall be subject to a minimum charge of $250.00. This fee shall be deducted from the Lessee's Security Deposit or charged to their credit card. Furthermore, in cases where extensive cleaning is necessary to address stubborn stains, spills, or malodorous conditions on the boat, a minimum fee of $150.00 shall be applied. This fee accounts for the labor and materials required to restore the boat to an acceptable standard of cleanliness. For more minor cleaning tasks, such as spill remediation and general trash removal, a minimum fee of $50.00 shall be levied. This fee covers the cost of labor and supplies associated with addressing these issues. It is imperative that the Lessee takes all necessary precautions to ensure the proper care and cleanliness of the rental items throughout the duration of the rental period to avoid incurring these fees. Failure to do so may result in financial penalties and may affect the Lessee's Security Deposit. Fuel Charges: · The Lessee is explicitly responsible for ensuring that the boat is returned with a full tank of fuel. Failure to adhere to this obligation shall result in a one-time fueling fee of $30, in addition to the prevailing market price for gasoline containing 93 octane or higher. Should the Lessee opt to refuel the boat themselves and return it with a full tank, no refueling charges shall be imposed. The refueling process may be executed either by the Lessee or by the designated boat fuel supplier, in accordance with established protocols and arrangements. Assignment and Sublease: · The Lessee may not assign or sublease any interest under this Agreement without written consent from the Lessor. · Unauthorized assignment or subleasing may result in forfeiture of the security deposit. Remedies: · The Lessor retains the right to pursue any and all remedies available under this Agreement, at law, or in equity. · In the event of disputes, the Lessee may be liable for attorney's fees and court costs. Binding, Waiver, and Severability: · This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings. · Invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions. Conduct Policy: · The Lessor reserves the right to refuse service to any individual displaying rude, obnoxious, or unsafe behavior. · Consumption of drugs or alcohol by minors or any unauthorized individuals is strictly prohibited. · Violation of these policies may result in cancellation of the rental without refund. Security Measures: · The Rental Company shall provide instructions to the Renter regarding proper security measures, including but not limited to securing the boat when not in use, safeguarding keys, and preventing unauthorized access. · The Renter agrees to take all reasonable precautions to prevent theft, vandalism, or damage to the rental items. Inspection Prior to Rental: · The Rental Company shall provide a two-day grace period to the Renter for inspection purposes preceding the commencement of the rental period. This timeframe is designated to afford the Renter ample opportunity to conduct a comprehensive examination of the rental items, meticulously documenting any pre-existing damages or discrepancies. During this designated inspection period, the Renter shall be granted the opportunity to thoroughly assess the rental items and acknowledge their condition before formally accepting the terms of the rental agreement. This meticulous inspection process is implemented to ensure utmost transparency and accountability between the Rental Company and the Renter, thereby preempting potential disputes regarding the condition of the rental items. Documentation of Condition: · Both parties agree to document the condition of the rental items through photographs or written descriptions at the beginning and end of the rental period. · Any discrepancies or damages discovered upon return of the rental items shall be compared to the initial documentation to determine responsibility. Insurance Requirements: · The Rental Company may require the Renter to provide proof of adequate insurance coverage for the rented items, including liability coverage and coverage for theft, loss, or damage. · The Renter agrees to maintain insurance coverage throughout the duration of the rental period and provide proof of coverage upon request. Substitution of Rental Items: · In the event that the requested rental item becomes unavailable due to unforeseen circumstances, the Rental Company reserves the right to substitute a similar item of equal or greater value at no additional cost to the Renter. · The Renter shall have the option to accept the substituted item or request a refund of any payments made for the unavailable item. Notification of Changes: · The Rental Company shall notify the Renter in writing of any changes or amendments to the terms and conditions of the rental agreement, including changes in rental rates, policies, or procedures. · The Renter agrees to promptly review and acknowledge any such changes to the agreement. Confidentiality: · Both parties agree to maintain the confidentiality of any proprietary or sensitive information disclosed during the course of the rental agreement. · Information exchanged between the Rental Company and the Renter shall be used solely for the purpose of fulfilling obligations under this agreement. Termination of Agreement: · The Rental Company reserves the right to terminate the rental agreement immediately in cases of non-compliance with the terms and conditions outlined herein. · Termination of the agreement shall not relieve the Renter of their obligations, including payment for any damages or liabilities incurred during the rental period. Waiver of Jury Trial: · Both parties hereby waive their right to a trial by jury in any legal proceeding arising out of or related to this agreement. · Any disputes shall be resolved through arbitration in accordance with the rules and procedures of the American Arbitration Association. Damage Prices: Lessee acknowledges and agrees that in the event of damage to the rented items, failure to provide full payment within seven (7) days of billing may result in additional charges at the discretion of the Lessor. This may include charges for lost revenue due to extended downtime for repairs, and Lessee authorizes the Lessor to charge the card on file for any such damages incurred. Lessee further agrees to bear the daily rental fee until full payment is received to compensate for the downtime of the rented items. The following damages and associated repair costs are provided for reference, but do not limit or release the Lessee from liability for damages caused by Lessee and/or their guests' actions or neglect: - Ding on prop: $250 and up - Severe damage to prop: $650 and up - Fiberglass damage under 2 inches: $200 - Fiberglass damage over 2 inches: Price will be determined after inspection by repair shop - Dent on aluminum rail: $200 and up (up to $600). - Hole in toon: $500 and up - Broken/missing ignition key: $50 - $100 - Tear in upholstery: $250 and up - Tear in Bimini: $650 and up - Broken Bimini frame: $3000 and up - Rope in Jet or prop: Loss of deposit - Tow: $200 and up - Radio: $300 - Speakers (each): $75 - Beaching boat: Loss of deposit and may incur additional costs Replacement cost for: - Anchor: $150 - $250 - Grill $400 - Splash Pad $450 - Tube: $300 and up - Tube Rope: $100 - Wakeboard Rope: $75 - Pump: $40 - Harness (pontoons only): $75 - Flag: $15 - Float Pillow: $45 - Gas Cap: $45 - Life Vests (each): $50 Please note that prices for other items not listed may vary.
