Pontoon Boat Rental Agreement and Liability Release This Rental Agreement and Liability Release ("Agreement") is made and entered between the Owner and Renter. 1. Rental Period and Rates - Hourly: $50 per hour, with a minimum of 3 hours ($150) - Full Day: $250 2. Rental Details - Boat Model: Manitou 20 Oasis - Engine: 50 HP Mercury 4 stroke engine - Capacity: Up to 10 people - Location: Lake Tichigan (279 acres, maximum depth of 63 feet) - Included: Full tank of gas, life vests for children under 13 - Parking: Up to 3-4 cars at our driveway 3. Activities and Restrictions - No tubing or water skiing allowed - Smoking (cigarettes or marijuana) is prohibited - Avoid shallow areas - Pets: One dog allowed with prior approval and additional fee (bring own dog vest) 4. Renter's Responsibilities - Must have experience operating and docking a pontoon boat - Ensure all operators and passengers are aware of and comply with rules - Operate the boat in a safe and lawful manner - Return the boat in the same condition it was rented, except for ordinary wear and tear 5. Payment Terms - Full payment due at booking - Security deposit of $[Amount], refundable upon return of the boat in good condition - Overtime charges: $[Amount] per hour for late returns 6. Cancellation Policy Full refund for cancellations made more than 48 hours in advance No refund for cancellations made less than 48 hours in advance 7. Liability Release Renter releases our company/owner from all liability for any injury, death, loss, or damage resulting from the use of the rented pontoon boat. Renter agrees to indemnify and hold harmless our company/owner from any claims arising out of the Renter's use of the boat. Terms and Conditions Inspection and Return: Renter certifies the boat and equipment are in good working order upon inspection and agrees to return them in the same condition. Deposit Use The deposit may be used for: - Damages beyond ordinary wear and tear - Unreturned or lost equipment - Overtime charges Prohibited Use The boat may not be operated: - Unsafely, carelessly, negligently, or illegally - By anyone under the influence of alcohol or narcotics By anyone who has not signed this agreement Operator Responsibility: Renter is responsible for safe and proper operation and agrees not to hold Owner liable for any inconvenience, damages, or time lost due to accidents or equipment failure. Reporting Issues: Any accidents, equipment failures, or defects must be reported immediately. Continued use after discovery is at Renter's risk. Availability: Availability is subject to previous renters returning the boat on time and other factors beyond the Owner's control. Additional Terms: Renter agrees to abide by all additional posted terms at the rental location. Waiver and Release of Liability - Disclaimer: This waiver applies to all renters, operators, passengers, and users. Renter must disclose all potential operators and users. - Assumption of Risk: Renter assumes all risks associated with renting, operating, or using the boat, including injury, illness, damage, or loss. - Liability Release: Owner is not liable for personal injuries, property loss, or damages arising from the use of the boat, even in cases of negligence, except in cases of gross negligence or intentional torts. - Third-Party Liability: Renter agrees to indemnify and hold harmless the Owner for injuries or damages to third parties resulting from the boat's use. - Acknowledgment: Renter acknowledges having read and understood this waiver, knowing its contents, and signs it voluntarily. - Severability: If any part of this agreement is void or unenforceable, the remaining terms remain in effect.
