Termes et Informations Additionnels

Read thoroughly - top to bottom! Failure to read and follow directions can result in additional charges or cancellation of your charter! No pets are allowed on our yachts! - no exceptions! Everyone onboard will be required to fill out a release of liability waiver! - no exceptions! Absolutely no weapons or guns allowed on premises or on the boat. No exceptions! Your charter will be forfieted immediately, $1000.00 fine assessed, and authorities contacted immediately.  Absolutely no drug use, or heavy drinking before you start your charter! If you are intoxicated in any form upon arrival, you will forfeit the charter for the whole group, be charged for the captain's time, and be escorted off of the premises!  We have laws and regulations that we need to abide by with the LCRA(Lower Colorado River Authority), Jonestown police, Game Wardens, and the Sheriff's Office, and this goes for each and every boat company operating on the lake. Passenger capacity is based on what is in this listing, no exceptions!  Failure to abide by this rule, will constitute breach of contract, and loss of all charter fees, and captain service fee will be charged at 20% to credit card, including processing fees.  Payment Policy: A credit card must be kept on file for a deposit in case of damages or policy violations.  $300.00 -$400 of the charter total will be charged at the time of booking to confirm the validity of the card.  The remaining balance may be charged up to 21 days prior to your charter date(usually we charge the week of your charter so that you don't have to carry a large CC balance).  ANY cancellations past 21 days prior to your charter date, you forfeit the full charter amount.          Price above includes everything EXCEPT a Captain Service Fee, which is a required amount of 20%.  Please do your best to collect this for the captain and crew before or throughout the party, as stated on the website, payments to your captain can be made via Venmo, Paypal, or cash. DO NOT stiff your captains, they work very hard to prep for your charter, make sure you are safe, and have a great time with us.   If the required amount is not given to the captain at 20%, your card will be charged for the full amount, or the difference, plus processing fees and taxes! Cancellation Policy: If it is raining at the marina or inclement weather is deemed hazardous by your captain within 30 minutes of your scheduled cruise start time, the charter may be delayed or can be rescheduled within 12 months of the current date. If the captain deems the weather hazardous, Lessee will receive a full refund minus $300 deposit, plus processing fees and taxes.  If it starts raining during the party, the party will continue unless the weather is deemed too severe by the operating captain or owner of the company, or unless the Lessee (party planner) decides they want to end the party early because of the weather, at which point a pro­rated refund will be issued.  Any party that ends early for any other reason will not receive a refund.  Should the Lessee choose to cancel the reservation for any reason within 3 weeks of the scheduled charter date versus rescheduling, Lessee will be not issued a refund for the total charter cost.   Policy Violations:  If any policy violations are observed on parking lot or marina premises or on board the party boat, fines may be assessed or party may be terminated at the sole discretion of the captain, owner of the company, VIP Marina, or North Shore Marina with no refund.   A list of violations can be found on the following pages of this rental contract.                                                    LESSEE TO READ ALL PAGES OF THIS AGREEMENT In consideration of the agreement herein, The company (hereinafter referred to as the LESSOR) agrees to serve as guide to the undersigned (hereinafter referred to as the LESSEE) and his party on a charter cruise for the time period specified above.  If the lessee or members of the lessee’s party cause the vessel to return to the marina later than scheduled for any reason, the lessee agrees to pay twice the hourly rate as appropriate. The lessee certifies that he/she will comply with all safety rules and regulations as posted and conveyed by lessor and/or crew, and further certifies that he/she has read and understands said rules and regulations. Lessee hereby agrees to the Terms & Conditions and recognizes that the rules and regulations set forth therein are applicable from the time lessee’s group/charter enters the marina parking lot, during their charter event and until the time they exit the parking lot after the cruise. Lessee recognizes that the Terms & Conditions are available for review only and are not negotiable or up for discussion under any circumstances. The lessee certifies that he/she has read and understands said rules and regulations. Lessee agrees to take complete responsibility for the actions, behavior, safety, and wellbeing of his/her guests. Lessee also agrees and understand that there will not be a Lifeguard on duty during the charter.  Lessee understands that is his/her responsibility to ensure that all of said guests are aware and understand the rules and regulations specified in this contract, on board, and by lessor/crew. In the event that there is not another cruise scheduled after the lessee’s time slot, and the lessor determines it is possible, the lessee may elect to increase the length of his/her cruise by the hourly rate specified by the captain and approved by Management. Lessee agrees to report any accident, malfunction, or breakdown of rental craft to lessor immediately in accordance with the MALFUNCTION/BREAKDOWN clause which follows. I, the lessee, authorize the lessor to charge my account for any damages or loss of equipment, including but not limited to tables, chairs, or other items provided by the lessor and staff throughout the duration of my cruise, including immediately before and after. The lessee acknowledges he/she has carefully examined the craft and finds it suitable for the purpose for which it is leased, and that or other accessory equipment is in suitable and acceptable condition: that he/she will maintain both craft and equipment in a safe, dependable condition while he/she has custody. Lessee acknowledges that it is his/her responsibility for the safety and welfare of other boaters, persons, and passengers. It is AGREED AND UNDERSTOOD BY LESSEE that the lessor shall not be held liable for damages, inconvenience or time lost caused by accident. Lessor further agrees to indemnify and hold harmless the lessor and its agents, affiliates and personnel from, and against any and all claims for loss of or damage to property or injury to persons (including death) resulting through the use, operation or possession of said rental craft. Lessee further agrees to hold the lessor harmless should loss or damages occur to any lessee’s (or guests’) personal property while carried in, or on, the rental craft, including loss or damage by fire, water, theft, or any other causes whatsoever. Lessee understands and acknowledges he/she is solely responsible for the welfare and wellbeing of his/her guests and that swimming/diving etc are at their own risk. Lessee expressly agrees to indemnify and hold lessor and its agents, affiliates and personnel, harmless of, from and against any and all loss, cost, damages, attorney fee and/or liability in connection with the enforcing of the forgoing rental contract by lessor, including expense incurred in connection with attempting to collect delinquent rent and in the event of suit by lessor, to recover possession of said rental property and/or to enforce any terms, conditions and/or provisions hereof. It is understood and agreed that Venue and any action hereunder shall be in the county of lessor. In the event of malfunction, breakdown, or if any defect is discovered after acceptance of the rental craft the lessee will immediately report it to lessor. Continued use of it shall be entirely at the lessee’s risk and thus lessee assumes all liability of injury and damage to all persons and property that may become involved by its continued use. Lessor’s ability to provide a rental craft if reserved, is contingent upon and subject to the return of the unit by the previous lessee, or any other cause beyond lessor’s control. Lessee understands and accepts that the vessel will return to the Marina up to 30 minutes prior to the contracted end party time to allow for travel time, and to allow guests to vacate the vessel at the allotted end time as stated in the signed lease agreement between the Lessee and Lessor. The rules and regulations contained herein and as posted on the vessel or elsewhere are for the safety and welfare of all who use the facilities. The lessee certifies that he/she has read and understands said rules and regulations and further assumes the responsibility that his/her family and or guests will obey the rules. Lessee acknowledges that any policy violations observed in the parking lot, on marina premises, on board the party boat, or anywhere on the lake or lake shore, may result in fines being assessed or the party being terminated at the sole discretion of the captain or owner of the company with no refund. Violations with such penalties include but are not limited to the following: RULES ● Fighting, verbal abuse, deliberate disrespect, threats, or physical acts of intimidation towards captain, crew, guests, employees or tenants of Paradise Cove Marina, or regardless of whether violation occurs in the parking lot, on marina premises, on the boat, in the lake, or on the shore: ● $500 fine and law enforcement will be called ● Explicit language on marina or parking lot premises, regardless to whom it is directed: ● $200 fine and termination of party ● Individual jumps off the boat before it is parked and engines turned off and chains are lowered at the swimming location or dock: ● $500 fine per occurrence and termination of party ● Urinating any place other than the toilet or deliberately trashing the bathroom ● $200 fee and early return to clean up before next party arrives ● Disobeying rules discussed in safety orientation or disregarding orders/requests of the captain and crew at any point before, during, or after the cruise ● $200 fine and termination of party ● Damage to furniture/equipment aboard the boat ● $100 plus cost of repair/replacement ● Any individual or group vomits, passes out, their safety is in question, or the captain/crew deems them too intoxicated to remain on board safely: ● Cruise ends early with no refund And could result in the Paramedics being called, fines to be incurred by Lessee. ● Excessive mess is made on the boat that will require extra time to clean up before the next party: ● $200 cleanup fee and early return to clean up before next party arrives ● Any individual or group deliberately makes a mess that captain and crew will have to clean up, including but not limited to throwing trash, littering in the lake, trashing the bathroom, throwing food everywhere, spilling drinks, knocking over speakers, breaking chairs, etc. ● $500 fine and immediate end to the cruise Should any term or condition of Rental Contract be held void or unenforceable then that term shall be deemed severed from this Contract and the remainder shall not be affected and will remain in full force and effect. WARNING: There are significant elements of risk in any adventure, sports, or activity associated with the outdoors, the presence of use of motorized watercraft and activities on, in and around the water. Certain risks cannot be eliminated without destroying the unique character of the activity. EXPRESS ASSUMPTION of RISK and RESPONSIBILITY: I assume the risk(s) of personal injury, accidents and/or illness, including but not limited to sprains, torn muscles and/or ligaments, fractures, eye damage, cuts, wounds, scrapes, abrasions and/or contusions; dehydration, drowning, exposure; head, neck and/or spinal injuries; bites, stings and/or allergic reactions; shock, paralysis or death. I/we agree to assume responsibility for the risks identified above and any risk not specifically identified. My/our participation in this activity is purely voluntary. I verify that I am physically fit, not under the influence of drugs or alcohol and sufficiently qualified and capable of participating in these activities. Therefore, I assume full responsibility for myself, including any minor children, for which I am responsible, for bodily injury, accidents, illness, death, loss of personal property, and expenses thereof as a result of any accident that may occur. I/we elect to participate in spite of the risks. RELEASE: In consideration of the services or property provided, I for myself and any minor children for which I an responsible, and heirs, personal representatives or assigns agree that: The company, its principles, directors, officers agents, and employees shall have no liability of any nature for any and all damage to me and other persons or property as a result of any acts, omissions, or negligence of the company or any other person or entity and I hereby release and discharge by the company and insurer, if any for any such damage. Alcoholic Beverage Waiver I/We do hereby hold harmless the company, its officers, directors, employees and contractors criminally and civilly from any liability arising from the consumption of alcoholic beverages by myself/ourselves or our invitees and guests. I/We warrant that any consumption of alcoholic beverages will be done in compliance with all state and Federal laws pertaining to the consumption of alcoholic beverages. I/We warrant that the company has not provided any alcoholic beverages to me/us or our invitees and guests as part of the rental of any boat or watercraft. I/We further agree to prevent any consumption of alcoholic beverages by any person under the age of twenty-one and take full responsibility for any incident where this may occur, I/We agree to hold harmless the company, its officers, directors, employees, and contractors from any liability criminally or civilly arising out of any occurrence of alcohol consumption by minors.
