Customer Responsibilities and Liability Waiver 1.     Safety: CUSTOMER agrees that he/she has examined the craft and equipment and finds it acceptable and suitable for the purpose for which it is leased and that he/she will operate the craft in accordance with all safety rules and regulations as posted by 43 North Marina, LLC or on the craft and further certifies that he/she has read and understands the rules and regulations. 2.     Return Time: CUSTOMER shall return boat on time and failure to do so will result in overtime charges of $25/qtr hour. 3.     Boat Handling: CUSTOMER is experienced and capable in all aspects of the handling and operation of the craft being rented and agrees that the craft’s listed weight and 12-person capacity will not be exceeded. CUSTOMER is aware of the NO WAKE zone and the NO GO zone as described by 43 North Marina, LLC and shown on the diagram on the boat and is responsible for any damage caused by the boat’s wake or by going into prohibited areas. 4.     Operators: CUSTOMER agrees that only those persons listed above shall operate the boat and further agrees to be personally liable for all damages caused by or claims made by non-disclosed operators. 5.     Breakdowns: In the event of malfunction, breakdown, or if any defect is discovered after acceptance of the rental craft the CUSTOMER will immediately report it to 43 North Marina, LLC. Continued use of the boat shall be entirely at the CUSTOMER’s risk and thus CUSTOMER assumes all liability of injury and damage to all persons and property caused by continued use. 6.     Waiver: The undersigned agrees that he/she is renting, operating or using the equipment provided by 43 North Marina, LLC at his/her own risk. Such risk includes but is not limited to risk of personal injury and or loss of personal property to customer and his or her guests, passengers, friends and family. It is AGREED AND UNDERSTOOD BY CUSTOMER that the LESSOR (43 North Marina, LLC”), shall not be held liable for damages, inconvenience caused by accident, breakdown or malfunction of the rental craft. CUSTOMER FURTHER AGREES to indemnify and hold harmless the 43 North Marina, LLC and its agents, affiliates and personnel from and against any and all claims for loss of or damage to property or injury including death to persons, including minor children, resulting from the use, operation or possession of said rental craft. CUSTOMER expressly agrees to indemnify and hold 43 North Marina, LLC and it agents, affiliates and personnel harmless of, from and against any and all loss, cost, damages, attorney fee and or liability in connection with enforcing this rental contract, including expense incurred in connection with attempting to collect delinquent rent to recover possession of said rental property and or to enforce any terms, conditions and/or provisions hereof. It is understood and agreed that Venue and any action hereunder shall be in Oswego & Onondaga COUNTY, NY This Waiver and Release is applicable to all CUSTOMERS, renters, operators, passengers and users of equipment and facilities provided by 43 North Marina, LLC, its principles, employees, agents, representatives, assigns, successors and insurers. 7.     Enforceability: Should any term or condition of this Rental Agreement be held void or unenforceable then that term shall be deemed severed from this Agreement and the enforceability and the remainder of this Agreement shall not be affected and will remain in full force and effect. THE TERMS AND CONDITIONS OF THIS CONTRACT, INCLUDING THE ATTACHED RULES AND REGULATIONS, CONTAIN THE ENTIRE UNERSTANDING BETWEEN CUSTOMER AND 43 North Marina, LLC AND NO OTHER REPRESENTATION OR INDUCEMENT, ORAL OR WRITTEN HAS BEEN MADE WHICH IS NOT INCLUDED IN THIS RENTAL AGREEMENT. I (WE) HAVE READ ALL PAGES OF THE AGREEMENT AND FULLY UNDERSTAND THE TERMS AND CONDITIONS AS SET FORTH ON ALL PAGES AND I (WE) ACKNOWLEDGE RECEIPT OF A COPY OF THIS AGREEMENT. BOOKING IS CONSIDERED AN ACCEPTANCE OF POLICY.         Rental pick up time is between 9:15 AM-9:30 am Cancelation Policy: - Week day rentals must be canceled 72 hours before rental with a $100 nonrefundable payment. - Holiday and weekend rentals must be canceled two weeks in advance with a $200 nonrefundable payment. - If it is a holiday week , you must cancel two weeks in advance with a $200 nonrefundable payment. - No REFUNDS, Reschedules Only!!! Eligible Renters: - Renters and drivers must be at least 21 years of age. - Renters and drivers must have a valid driver’s license. - The person who signs the rental contract is required to fill out the rental agreement and held responsible for the pontoon during their rental period. How Renting a Boat Works: - Renters must call to reserve a boat. If you walk-in, we cannot guarantee there will be a boat available to rent. - To reserve your rental, the full payment is taken at the time of the reservation. You can pay with credit card. - A $1,500 security deposit is authorized to your credit card the day of the rental. If there are no damages incurred during your rental, (Refer to the DAMAGES section below) the deposit will be released and you will not be charged anything. - Rental rates do not include tax, fuel or gratuity. The Rental Times: - Full day rental times are from 9:30 am – 4:30 pm. - Pick up time is 9:15 am. - Return time is between 4:15pm-4:30 pm. - **Boats must be at fuel dock by 4:15, gassed up and in the slip by 4:30 pm. (After 4:30 pm every 15 minutes is $25 charged to card, after the first hour is $200) Rental Rates:  Our rates are structured according to weekdays, weekend days and holidays. Important Notes: - Rental boats are prepared with a full tank of gas at the beginning of the rental. Upon return, gas dock attendants will help you park the boat if needed and “top off” the fuel tank. The renter is only responsible for the fuel used during their rental. - FAILURE TO RE FILL THE BOAT will result in a $25 surcharge plus the cost of the fuel. - Renters are responsible for all damages incurred during their rental period. - Absolutely no pets or grills are allowed on boats. - 43 North Marina, LLC renters may take boats as far as Sylvan Beach - 43 North Marina, LLC renters are NOT allowed to lock through the damn. - On the day of the rental reservation, the driver of the boat is required to bring a valid driver’s license and a valid credit card (debit cards are not acceptable). If these two cards are not available the day of the rental, then we cannot send out the rental or fix the charges on the credit card. Damages: - We will authorize a $1500 security deposit on your credit card. - Renters are responsible for all damages incurred during their rental period up to $1500.00 - After damage assessment upon return of the boat, any damage will be estimated and charged to your $1500 security deposit immediately. - Refusal to pay for damages assessed will result in immediate notification to all credit reporting agencies, and we will file suit with small claims court where you will be required to pay our attorney’s fees and court costs in addition to the charge for the damages. - If you do not agree with our assessed damage cost, we will at the time charge the entire $1500 and have the damages professionally assessed, and then refund you the remainder of your deposit if any remains. - Quite often, our assessment is less than the professional assessment we receive, therefore, it may be in your best interest to pay for the damage assessed on site. - Anyone refusing to pay for damages to our equipment will also be banned from ever renting our equipment in the future. Safety: - It is unlawful to operate a vessel under the influence. Conviction for operating under the influence will result in fines, jail sentence and may also be imposed for any conviction and operating privileges may be suspended from one to ten years. Additional federal penalties may also be charged. - For your safety, do not enter the water without a lifejacket on, engine turned off and key removed. - Conduct a head count before starting the engine. - Maintain a safe speed and monitor your surroundings at all times - Keep a safe distance from other boats and follow all local laws and regulation (parks.ny.gov/boating/education) - Remain seated while boat is in motion. - Absolutely no sitting on the bow, sides or stern - Importance of attaching the engine shut-off lanyard. - Engine start and shut off procedures. - Dangers of CO2 - Sound of the horn or whistle to signal danger or need for help. - All tube riders must have a life jacket on at all times. ​ Inclement Weather Policy: - If there are inclement weather conditions on Oneida Lake area prior to departure time, then the rental reservation will be postponed or delayed. Inclement weather is defined as weather where there are unsafe conditions, such as a warning of severe, high wind advisory or tornado as defined by the National Weather Service. You will be able to reschedule the reservation during the same rental request within a 30-day period or depending on boat availability. - If weather conditions are overcast, cloudy and rainy, but no use of warnings are issued by the NYS, your rental still stands for the day. - In the case weather turns severe while you are on the lake, seek a place of safety such as a cove, an inlet or a protected shoreline and anchor the boat at the bow (front) into the wind.
