TERMS AND CONDITIONS: In accordance with UAE regulations, the obligations and duties of our crew exclusively encompass the safe operation and maintenance of the vessel as well as the safety of its passengers. Our Crew has no other obligation or duties to the Client or guests. The Charter Company shall be the sole determiner regarding suitability and attachment of decorations. Smoking is strictly prohibited inside all our yachts Client and guest will be subject to both Charter Company and Marina Security and safety requirements. Passengers must carry an original identification card [passport, driving license, ID card] during the trip. The client hereby assumes responsibility for damages to the yacht caused by himself, contracted service providers, or guests. Reparations for damages shall include the costs or repair and restoration, transportation of this yacht and any loss of income caused thereby. Yacht charter fee includes: Selected Yacht, Captain and at least 1 Crew Member, fuel, water, ice, soft drinks, towels. On board BBQ griller on request [additional charges] No liability is accepted for any personal injury during recreational activity including cruising, swimming, fishing, parasailing or any other water sport. All passengers must wear life jackets whilst cruising ONLY. All guests are advised to take off their footwear while on board. Master’s bedroom will be kept close, private and not for use of guests. YACHT RENTAL PAYMENT TERMS: Additional charges for catering & transportation, a 100% upfront payment - prior to charter booking [non-refundable] 50% upfront payments (together with the security deposit) in Cash/Credit Card are accepted to confirm the charter booking. Balance to be paid 24hours in CASH before the trip. In case of use of credit card, we will charge 2.5% [additional fees for bank charges]. Reschedule booking, should be communicated before 72 hours, Note: yacht is subject to availability. In case of authentic mechanical breakdown or bad weather, payment is non-refundable, we will reschedule your booking subject to yacht availability. Elite Pearl Charter waives responsibility to any delay or cancellation of the trip due to Negligence and Misbehavior of the guest. The client hereby assumes responsibility for damages to the yacht caused by himself, contracted service providers, or guests. We make no warranty against any incident, accident or any other fault or misused or problems which may occur. We will not be responsible for any loss or damage, injuries whatsoever caused resulting from a failure or misconduct as a result of any misuse or misbehavior from the guests. CANCELLATION BY CLIENT: Client cancellation shall result in forfeiture of deposit and fees as follows Within 3 days of charter date, 100% of the total charter value. 4 Days up to 30days of charter date, 50% of the total charter value. CANCELLATION BY ELITE PEARL CHARTER: In case of authentic mechanical breakdown or bad weather, In the case of reschedule, deposit refund remains subject to this agreement and will be subject to yacht charter availability. Coastguard restrictions or UAE Law enforcement decrees. In this instance, the charter will be rearranged subject to yacht availability. If this is not possible, any charter fees already paid will be returned along with security deposit.
