We had a great experience on Samo's boat; the pontoon was spacious and clean, great for 8 adults and 2 kids less than 2 years old. Plenty of room for us and for our food & drinks. It was easy to coordinate with Samo, and the boat was easy to operate around the bay.

Gorgeous Pontoon boat for cruise in the beautifulI marina and bay of long beach. Bring your drinks and food and enjoy your good time and the shining sun while riding. You can go to restaurants around the bay. captain is available by request from 8 am to 9pm.

1. Small Boat Lease Agreement 1.1 This Bareboat Charter Agreement ("Agreement") is made and entered into between [GAMRAOUI OUSSAMA] ("Owner"), an individual residing in California,_____________ and ____________________("Lessee") (collectively the "Parties") on ____________. 1.2 Owner owns the HARRISFLO BUILT IN 2010, OF CLASS AK, LENGTH 20 FEET, registered with DMV, California, CF NUMBER: CF 1312 RU, ("Vessel"), which Owner desires to lease to Lessee on a bareboat charter basis for Lessee's personal pleasure and non-fishing charters, and Lessee desires to lease the Vessel on the terms and conditions set forth herein. 1.3 This Agreement shall be governed by and construed in accordance with the laws of the State of California. The Parties consent and submit to the jurisdiction of the state and federal courts located in California for any lawsuits arising under this Agreement. 2. Lessee's Qualifications 2.1 Lessee represents and warrants that Lessee is proficient in the safe operation of the Vessel and holds all licenses required under California law to operate the Vessel. Prior to taking possession of the Vessel, Lessee shall provide Lessor with copies of all valid licenses held by Lessee that are required to operate the Vessel under California law. 2.2 During the Lease Term, Lessee shall maintain all licenses required under California law to operate the Vessel. Lessee shall provide Lessor with evidence of renewal of such licenses prior to their expiration. Failure to maintain required licenses shall constitute a material breach of this Agreement. 2.3 Lessee shall operate the Vessel in a safe, lawful and responsible manner, abiding by all applicable California laws and regulations related to operation of the Vessel. Lessee shall not operate the Vessel in an unsafe or hazardous manner or while under the influence of alcohol or drugs. 2.4 Lessor shall have the right to require Lessee to demonstrate proficiency in operating the Vessel prior to the start of the Lease Term. If at any time Lessor determines, in its reasonable discretion, that Lessee lacks sufficient skill to safely operate the Vessel, Lessor may terminate this Agreement immediately upon notice to Lessee. 3. Use of Vessel 3.1 Lessee shall use the Vessel only for personal pleasure activities and non-fishing charters during the Lease Term. Use of the Vessel for any other purpose is prohibited without Owner's prior written consent. 3.2 Lessee's use of the Vessel shall comply with all applicable federal and California laws and regulations. Lessee shall obtain any necessary licenses, permits, certifications, and registrations required for its use of the Vessel. 3.3 Lessee shall observe the State’s hours of rest to avoid fatigue while operating the vessel. 4. Insurance and Liability 4.1 Lessee shall maintain liability insurance policies covering its use of the Vessel. 4.2 Owner shall not be liable for personal injury, property damage, or other claims arising from Lessee's use and operation of the Vessel. 5. Safe Speed, 5.1 The lessee undertakes to always operate the boat at a safe speed to avoid collisions and be able to stop within an appropriate distance given the prevailing circumstances and conditions. 5.2 The lessee undertakes not to operate the boat more than 5 miles per hour, or the speed limit imposed by harbour authority whatever is less, in a reckless or negligent manner that could endanger life, limb, or property. 6. Compliance with California Boating Regulations 6.1 Lessee shall comply with all California boating laws and regulations governing the operation of the Vessel. This includes but is not limited to regulations regarding boating safety, navigation rules, and equipment requirements as outlined by the Department of Boating and Waterways. 6.2 Lessee shall familiarize themselves with and adhere to the specific boating laws and regulations applicable in the waters where the Vessel will be operated, including any speed limits, no-wake zones, and navigational restrictions. 6.3 The lessee is required to instal and use the necessary safety equipment as per the regulations established by the Department of Boating and Waterways. This includes personal flotation devices, fire extinguishers, and other safety gear that meets the standards set forth in the California Code of Regulations § 652. Safety and equipment regulations; Violation as misdemeanor; Penalties , § 40303.5. Promise to correct violation; Disqualifying conditions . 6.4 The operator of the boat must comply with specific conditions under which passengers are required to wear life preservers, such as during rough weather, loss of vessel integrity, or when navigating hazardous areas § 773.5. Required use of life preservers , § 773.8. Information as to life jackets; Securing dangerous objects . 6.5 The operator should also inform passengers about the availability and requirement of life jackets § 773.8. Information as to life jackets; Securing dangerous objects . 6.6 The operator to secure objects that may cause injury to passengers when leaving or returning to port and to use reasonable care in doing so § 773.8. Information as to life jackets; Securing dangerous objects . 7. Lease Period 7.1 The lease period shall commence on ________________ and continue till _______________. 7.2 Either Party may terminate this Agreement by giving one day notice in writing to the other if applicable. 8. Entirety of agreement 8.1 This Agreement constitutes the entire understanding and agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written, between the parties. Any modifications or amendments to this Agreement must be made in writing and signed by both parties to be valid. No waiver of any term or condition of this Agreement shall be deemed a waiver of any other term or condition, and any failure to enforce any provisions of this Agreement shall not constitute a waiver of such provision or any other provision." 9. Governing Law 9.1 This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to principles of conflicts of law. The parties submit to the jurisdiction of the state and federal courts located in California for any action or proceeding related to this Agreement. 10. If you are 20 minutes late to your scheduled appointment your ride will be CANCELED with NO REFUND! 3. The owners nor the staff will not be responsible for any lost or stolen personal items, please leave your personal belongs in your car. 4. Indemnification and Hold Harmless: The Renter agrees to indemnify and hold harmless the Owner and its agents from any and all claims, damages, or losses arising from the rental or use of the boat, including but not limited to: Loss of personal property, injury, death. 5. Usage Restrictions: The Renter agrees to use the boat safely, whilst maintaining common sense. and agrees not to engage in any prohibited activities, including but not limited to: Jumping off the boat while the boat is in motion, hanging off the side of the boat while the boat is in motion, drinking excessively, purposefully mishandling or damaging boat or boat property, littering overboard. The Renter must comply with all applicable laws and regulations while on board or operating the boat. 6. 1. You must have previous boating experience to drive this boat. • 2. This boat must remain inside Alamitos Bay at no wake speeds, it can not be taken out of the harbor. • 3. No swimming, beaching, towing, or anchoring with the boat. 7. The Renter agrees to not go under any bridges under any circumstances.
