GETMYBOAT JET SKI RENTAL AGREEMENT This Jet Ski Rental Agreement ("Agreement") is entered into on booking, by and between ("Rental Company"), and the booking client 1. RENTAL OF WATERCRAFT The Rental Company agrees to rent the following watercraft ("Jet Ski") to the Renter for the term and fees as outlined below: 2. RENTAL CONDITIONS AND USE The Renter agrees to the following conditions regarding the use of the Jet Ski: The Renter must be at least 18 years old (21 years old for high-performance models), hold a valid driver’s license, and be legally allowed to operate a Jet Ski in the state of Texas. The Renter agrees to operate the Jet Ski in accordance with all local laws, rules, and regulations set by the Texas Parks and Wildlife Code, and any applicable safety guidelines provided by the Rental Company. The Renter agrees to always wear a U.S. Coast Guard-approved life jacket while operating or riding as a passenger on the Jet Ski. The Renter shall not operate the Jet Ski under the influence of alcohol, drugs, or any substances that may impair their ability to safely operate the Jet Ski, including prescription or over-the-counter medications that may impair their ability to ride or operate the Jetski safely. The Renter agrees not to allow unauthorized individuals to operate the Jet Ski. The Renter shall only use the Jet Ski for lawful recreational purposes and shall not use the Jet Ski for racing, stunts, or any other activity that may damage the Jet Ski, endanger others, or violate State/Federal laws. The Renter agrees to return the Jet Ski in the same condition as it was rented, including returning with a full tank of gas but excluding normal wear and tear. 4. SECURITY DEPOSIT AND DAMAGE RESPONSIBILITY - The Renter is responsible for any damage to the Jet Ski caused during the rental period. This includes any physical damage to the Jet Ski, loss of equipment, and any damage caused by improper use. - The security deposit will be used to cover any damage, loss, or excess cleaning costs incurred during the rental period. If the total damages exceed the amount of the security deposit, the Renter agrees to pay the balance of the repair or replacement costs. - If the Jet Ski is lost or stolen during the rental period, the Renter agrees to cover the full replacement cost of the Jet Ski. 5. LATE RETURN AND FAILURE TO RETURN - If the Renter fails to return the Jet Ski on time, a late return fee will be charged at the rate of $150 per hour. - If the Renter fails to return the Jet Ski, the Rental Company reserves the right to report the theft to law enforcement and pursue legal action. 6. CANCELLATION AND RESCHEDULE POLICY - The Renter may cancel the reservation at least 5 days (120 hours) prior to the scheduled rental period for a full refund. - After 5 days (120 hours), the Rental Company does not offer refunds. However, the Rental Company will work with the Renter to find a suitable alternative time for the reservation. - A Reschedule Fee may apply depending on the rescheduled date, which will be communicated at the time of the rescheduling. - The Rental company reserves the right to cancel at anytime in cases of inclement weather the rental company will reschedule, the Renter will be notified of this as soon as is possible. 7. RENTAL COMPANY RESPONSIBILITIES The Rental Company agrees to: Provide Safe and Functional Equipment: The Rental Company shall provide the Renter with a Jet Ski that is in good working condition, free from defects, and fully operational for the duration of the rental period. All equipment shall meet safety and legal standards required by local and state regulations. The Jet Ski will be delivered to the Renter with a full tank of fuel and the necessary safety equipment (e.g., life jackets). Clear and Transparent Terms: The Rental Company shall ensure the terms of this Agreement are clear and will advise all renters to read through carefully, including all fees, obligations, and policies. Any changes to the terms will be documented and agreed upon by both parties in writing. Safety Instructions and Briefing: The Rental Company will provide the Renter with all necessary safety instructions regarding the proper operation of the Jet Ski, including but not limited to guidelines for safe riding, the use of safety gear, and emergency procedures before the rental period begins. Legal and Regulatory Compliance: The Rental Company shall comply with all applicable local, state, and federal laws governing the rental and operation of the Jet Ski. The company shall also verify that the Renter meets all legal requirements to operate the Jet Ski, including age, licensure, and safety course requirements. Maintenance and Repairs: The Rental Company shall maintain and inspect all Jet Skis to ensure they are in good working order prior to each rental. Should a mechanical issue occur during the rental period, the Rental Company will either repair the Jet Ski or provide a suitable replacement, subject to availability. Refunds and Rescheduling: In accordance with the cancellation and reschedule policy outlined in this Agreement, the Rental Company will adhere to the terms set forth for refunds and rescheduling requests. If the Renter needs to reschedule, the company will assist in finding an alternative time, subject to availability. Insurance and Liability: The Rental Company will provide the Renter with full disclosure of any insurance coverage or lack thereof, along with the Renter’s liability for damages, injuries, or loss of property. The Rental Company does not provide personal insurance for the Renter or third parties and does not accept liability for personal injuries or damages occurring during the rental period. Return of Equipment: The Rental Company is responsible for ensuring that the Jet Ski is returned on time and in the condition specified in this Agreement. If the Jet Ski is returned late or in poor condition, additional fees may apply, as outlined in the rental fees section. Security Deposit Handling: The Rental Company will handle the security deposit according to the terms of this Agreement, refunding it in full if the Jet Ski is returned without damage and all other conditions are met. The company will also communicate any deductions from the security deposit in the event of damage or breach of contract. Customer Support and Communication: The Rental Company will provide ongoing customer support and be available for communication during the rental period in case of emergencies or issues with the Jet Ski. The Rental Company will respond promptly to any concerns raised by the Renter. 8. OWNERSHIP AND CONTENT POLICY - No Ownership or Collaboration Implied: The renting of the Jet Ski by the Renter does not imply any ownership, partnership, collaboration, or joint venture between the Rental Company and the Renter, nor does it create any rights or claims outside the scope of this Agreement. The Renter acknowledges that the use of the Jet Ski is a rental arrangement only and that the Rental Company remains an independent entity. - Content and Reputation: The Renter agrees that any videos, pictures, or other content created or shared during or after the rental period, either by the Renter or their associates, shall not tarnish or harm the reputation, brand, or public image of the Rental Company. The Rental Company reserves the right to take appropriate action against any content, social media posts, or other actions that may harm its name, reputation, or business interests. - The Renter further agrees that they will not engage in any public statements, online content, or other activities that could negatively affect the public perception of the Rental Company, and any violation of this clause will be deemed a breach of this Agreement. 9. INDIVIDUALS UNDER 18 YEARS OF AGE - For children aged 13 or older, the Renter acknowledges and will provide evidence to show that the child may operate the Jet Ski only if they have completed an approved boater safety course, as required by Texas law. - If the Renter’s child is participating as a Rider Passenger, the Renter affirms that they have provided parental consent for their child to participate. - For children under 18 years of age, the Renter acknowledges that a parent or legal guardian must provide written consent for their child to operate or ride as a passenger on the Jet Ski, along with a copy of their Driver’s License or official ID. 10. LIABILITY AND INSURANCE - The Rental Company provides no insurance coverage for injury, loss, or damage to the Renter, passengers, or third parties during the rental period. The Renter is solely responsible for any personal or third-party injury or damage caused by renter or their party while operating the Jet Ski. - The Rental Company does not accept any liability for loss, theft, or damage to the Renter’s personal property during the rental period. 11. INDEMNIFICATION AND HOLD HARMLESS - The Renter agrees to indemnify, defend, and hold harmless The Company, its employees, agents, representatives, and affiliates from all claims, damages, legal costs, and liabilities that may arise from the Renter’s use of the Jet Ski. - This includes any personal injury, property damage, or claims made by third parties arising from the Renter’s actions, the actions of the Renter’s passengers, or the operation of the Jet Ski. 12. ENTIRE AGREEMENT This Agreement constitutes the entire agreement between the parties. Any modifications or amendments to this Agreement must be in writing and signed by both parties. 13. GOVERNING LAW This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. 14. SEVERABILITY If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. ACKNOWLEDGMENT By booking, the Renter acknowledges that they have read, understood, and agree to the terms and conditions set forth above. The Renter further affirms that all information provided is accurate and true.
