1. Booking and Payment 1.1. A reservation is confirmed upon receipt of a deposit or full payment. The deposit represents 20% of the total charter price. 1.2. Full payment is required before the start of the rental period. 1.3. Accepted payment methods include wire transfers, online payments, and cash. 1.4. Online payments made via PayPal or credit card are subject to a 4.9% surcharge to cover processing fees. 1.5. Cash and bank wire transfers do not incur any additional fees. 2. Cancellation Policy 2.1. Cancellations made by the client more than 30 days prior to the rental date will receive a full refund, minus a $45 USD administration fee. 2.2. Cancellations made between 8 and 30 days before the rental date will receive a 50% refund. Alternatively, clients may opt to reschedule the charter, subject to availability and a rescheduling fee. A $45 USD administration fee applies for both cancellations and rescheduling. 2.3. Cancellations made within 7 days of the rental date are non-refundable. Rescheduling may be offered at the discretion of Boat and Bay, subject to availability, with an applicable rescheduling fee and a $45 USD administration fee. 2.4. Rescheduling fees will be determined at the time of cancellation, based on operational costs. 2.5. Processing fees for credit card or online payments are non-refundable. 3. Late Arrival 3.1. Clients must arrive at the designated embarkation point at the agreed-upon time. A grace period of 5 minutes will be allowed for late arrivals. 3.2. If the client arrives after the grace period, the rental period will not be extended, and the client will still be responsible for the full booking amount. 3.3. Early returns do not entitle the renter to any refunds. 4. No-Show Policy 4.1. A client is considered a no-show if they fail to arrive at the embarkation point within the agreed time without prior notification. 4.2. In the event of a no-show, the client forfeits the entire booking amount, and no refunds will be provided. 5. Notification of Delays or Changes 5.1. Clients are required to inform Boat and Bay promptly of any changes to the charter, such as guest count, charter time, or other relevant details. Failure to communicate changes promptly may result in additional charges or restrictions. 6. Captain, Crew & Fuel 6.1. The rental fee includes a licensed captain and crew, as well as the cost of fuel. 7. Safety Regulations 7.1. All clients and guests must adhere to safety instructions provided by the captain and crew. Inappropriate behavior, including excessive alcohol consumption, will not be tolerated. The captain has the authority to enforce safety measures to ensure the well-being of passengers and crew. 7.2. Engaging in illegal activities, including the consumption of illegal substances, is strictly prohibited and may result in the immediate termination of the charter without a refund. 7.3. Clients are encouraged to obtain travel insurance to cover potential risks and liabilities. 7.4. Environmental guidelines, including proper waste disposal, must be followed to minimize the ecological impact. 7.5 Clients swim in the ocean at their own risk. We strongly encourage wearing a life jacket at all times when swimming or participating in water activities. 8. Changes by Boat and Bay 8.1. Boat and Bay reserves the right to modify bookings in the event of unforeseen circumstances such as mechanical failures or safety concerns. 8.2. If changes are necessary, Boat and Bay will notify clients as soon as possible and offer alternatives, including rescheduling, providing a replacement vessel, or offering a refund. If clients are unable or unwilling to accept proposed changes, a full refund will be provided. No additional compensation will be offered for changes due to unforeseen events. 9. Force Majeure / Bad Weather 9.1. Boat and Bay is not liable for delays or cancellations due to circumstances beyond its control, including severe weather, natural disasters, or government actions. 9.2. Bad weather refers to conditions that pose a safety risk, such as high winds, thunderstorms, or rough seas. Light rain or overcast skies do not typically qualify as bad weather, and the trip will proceed at the captain’s discretion. 9.3. Rescheduling and Cancellation for Bad Weather: • Captain’s Authority: The captain has the final authority to cancel, delay, or modify the trip based on safety conditions. • Same-Day Rescheduling: If the captain deems the weather safe but the client prefers to reschedule for later the same day, this can be arranged at no extra cost, subject to availability. • Rescheduling to Another Day: Clients wishing to reschedule for a different day despite safe conditions will incur a $45 USD administrative fee and a 70% charge of the total trip value. The remaining 30% will be credited for a future trip, valid for 2 years. • Unsafe Weather: If the captain deems the weather unsafe, the trip will be rescheduled at no extra cost, and no administrative fees will be applied. 10. Extension of Booking 10.1. Booking extensions are subject to availability and local regulations. Requests for extensions must be made at least 60 minutes before the scheduled end of the trip. 10.2. Payment for additional hours must be made via official payment channels. Direct payments to the crew are not permitted without prior approval from Boat and Bay. Failure to comply may result in the immediate termination of the charter. 11. Beach Stopovers 11.1. If a stopover is made at a beach or club, clients must return to the yacht at the time designated by the captain. Extensions of the stopover will incur additional charges, payable immediately. 11.2. Any delays to the yacht’s return time caused by stopovers are the client’s responsibility will be charged at the rate of an additional hour. 12. Guest Count 12.1. The charter is for the number of guests initially booked. No refunds will be provided for unused capacity. 12.2. If more guests are brought on board than booked, additional charges must be paid immediately. 12.3. The total number of guests must not exceed the legal limit set by local regulations. 13. Seasickness Provision 13.1. Passengers experiencing seasickness may request an early end to the charter, but no refund will be provided for lost time. The decision to terminate the trip early is at the discretion of the passengers. 13.2 The passenger may choose to disembark at the nearest marina or beach and will bear any additional costs, such as a water taxi, if not included in the original trip cost. 14. Items Permitted and Restricted On Board 14.1. Clients are encouraged to bring personal belongings such as clothing and care items. 14.2. Illegal substances, hazardous materials, or items that may endanger passengers, crew, or the yacht are prohibited. The captain and crew reserve the right to inspect and restrict any unsafe items. 15. Parental Responsibility 15.1. Parents or legal guardians are fully responsible for supervising their children on board. Any damage caused by children is the responsibility of the parents or guardians. 15.2. Parents are responsible for their children’s safety. We encourage wearing a life jacket for kids at all times while on board. Wearing a life jacket while swimming in the sea is mandatory for kids, even if they are proficient swimmers. 16. Confidentiality of Contact Information 16.1. Clients are prohibited from exchanging personal contact details with the captain or crew. All communications related to the charter or any future charters must be conducted through official Boat and Bay channels. 17. Damages and Liabilities 17.1. The renter is responsible for any damages to the yacht or its equipment caused by negligence or misconduct. 17.2. Boat and Bay or any of their employees or owners is not liable for injuries, accidents, or loss of personal property during the rental period. 18. Governing Law 18.1. These terms and conditions are governed by the laws of Mexico. By booking a yacht rental with Boat and Bay, the client agrees to be bound by these terms and conditions.
